Partnership agreement for buying house near fiance?
my fiance and I have put a bid on a house and expect to close back we marry. his lawyer who we are using for the closing is pushing us to bring in a partnership agreement since we are not yet married. he (my fiance) think this is a good conception but would prefer that we just hold a courthouse wedding (he be married previously) before the closing but this is my first conjugal and I want to wait for the marriage ceremony we have planned contained by 2009.doesn't the mortgage in both our name create a partnership agreement? is another one necessary? his advocate has not see our mortgage application and may not know it is joint. standard feedback or personal experience please.
Answers: You need a simple agreement outlining:
How much money respectively of you put down for the down payment (this is your % ownership).
That monthly mortgage payments will be made any from a joint side or by two checks (same %).
Acknowledge that repairs and maintenance will be rewarded in like peas in a pod rates.
Discuss whether one of you can buy the other out if you break up or if you must sell and distribute the proceeds...etc.
You both could enter into something call joint use. After getting married, you could change the action to community property.
