If you're building a house and sign a contract for estimated costs, if the budget exceeds $36,000, was the builder justifiably obligated to inform the buyer? Shouldn't the builder inform the buyer or have them provide approval via signature? What recourse does the buyer have?

Answers:   The buyer pays. Nothing ever comes within under the estimate. The estimate is purely that, the buyer needs to pay packet the actual bill.
