Buying a home, is propane fuel contained by lease cistern automatically included? Also, peddler staying after closing...?

My close friends are buying the house across the street from us, and the seller have a leased 200 gallon LPG cistern that's 2/3 full. He's been bugging me to ask them if they want to "buy" the fuel already contained by the tank (for roughly speaking $200-$300), otherwise, according to him, the gas company will come drain the tank(and not pay him anything for it).

Sounds to me similar to he's just trying to skeeze more change out of them (he's a moron, he was asking me to ask them if they needed to buy his other crap- mower, freezers, etc.) This, after the idiot is trying to stay in the house for 20 days after settlement previously moving to another state (as it is, he's staying at least 12 days). Anybody know the trial issues/precedent behind that, besides the marked insurance and liability problems?

I swear, if he calls or knock on my door one more effing time give or take a few this affair, me and Mr. AR-15 are gonna go postal on him and his dipshit kinfolk.

Answers:   I agree. They would not come & drain the tank, UNLESS skeeze asked them to. They would after only payment him back a discounted amount for the remaining fuel.

Normally, escrow, the agents or party contact the propane company & have them calculate the amount of remaining fuel. A credit could then be issued to the hawker at closing. Since the seller is remaining surrounded by the home, this would not be advisable to do at closing.

The buyer's could offer to purchase remaining fuel (after the peddler vacates) and the propane company has have time to come & ACCURATELY measure what's vanished. I would not rely on the seller's estimate of remaining fuel.

Normally, a buyer is entitled to receive rent from a seller if the buyer's possession of the property is delayed beyond 3 days after closing. In skeeze's luggage, I would recommend an amount sufficient that is over & above the buyer's monthly mortgage return otherwise, skeeze has unquestionably no motivation to speed up vacating the home.

It might not also hurt to error on the side of forewarning and have some of the seller's proceeds held fund at closing (escrow holdback) in the event he delay his tenancy or leaves the home contained by a less than favorable condition.

I hold a feeling this isn't the second on this saga, lol...

Have your friends make sure their realtor notify the other party that the merchant has to be out and the key turned over. Else they will charge him 1 months rent, to be paid at the time of closing - certified check, not personal. Make the rent equal to 2 house payments, that should catch his fanny moving.

They do not drain the propane tank, but they may remove it. The buyer should contact the propane supplier. Often the cistern and remaining fuel stays for the new owner because the company is interested surrounded by keeping customers. I do not know about propane but heat oil the buyer have to pay the merchant for the gallons that are in the container. This is what the buyer's lawyer is suppose to toy with.

On the other appendage, he's a goober. I bought a new house contained by '06 when I relocated to No AZ. Has propane. House came near what was contained by the tank. I've NEVER hear of a gas company coming to "reclaim" their product. Especially since it's usually paid for surrounded by at the time of delivery.
