Renting Real Estate Question and Answers

If I owner nouns my home & they build on it, next defaulting, what happen?

Question:
I hold the title to this land & longing to owner finance it to someone. What if they build on it and after default on the make a note of? Maybe the bank would fold it into the latest construction home loan?

Answer:
The bank will forclose on you for the document on the mortgaged land.
I doubt the builder will take a contruction loan to build on such land. Or,
Until compensated... there can be no clear title on any house and lawsuits will follow on you.
Make a stipulation that no building can be done on it until it is salaried foravoid the possible headaches. They might know how to get it rolled into the loan for building the house. The final thing you want is a situation similar to you describe, them defaulting on the property and then have a home on the land. Consult a solid estate lawyer, it shouldn't cost you too muchor only just ask some property brokers, they should be able to supply you the right answer.
How is the bank involved if you are "owner financing".

If the celebration you sell the environment to defaults on the loan that you are carrying, the property ownership reverts backbone to you, anything they built would belong to you. Anything that could be hauled bad, not permanently attached, they can pocket with them.

You can next go after them legitimately for the default on your details.

Hire an attorney to draw up your sales agreement on the property.
your loan must be salaried first before any construction loan if you did the memo and mortgage correct with no sub-ordination clause. If you do not know what I am discussion about you should not be financing ground for buyers. a fool and his money are soon parted.

If your mortgage/ register is second place (junior lien) you must pay rotten the construction loan to protect your security and after you foreclose and take support the land if not get remunerated what is owed by whoever bids higher than you. If you do not own the money to do this, you must borrow it on the constructed improvement (if done,) if not on the land. it is complicated and you own not given enough facts. see an attorney QUICK!
It would be a bit complicated within that matter. I'd articulate the bank would be interested within doing the whole loan. With you holding title to the manor the bank wouldn't own much of a way to repossess the unbroken thing. They could merely repossess the home on the land and that would be difficult. If that did come to pass, I'd say the mound could have a lien on your territory. Talk to whatever mound they will use to finance and see what they read aloud.
In most, if not adjectives, states, you would own any improvements to the land if the buyer default. If they built a permanent building here, that becomes yours. They would own the right to remove a mobile home or temporary/movable structure.

If they were financing the building of a house on the house, the bank would probably want to rate you off past they financed something they could lose.
You get the property spinal column, including all the improvements constructed on it to that point. However, if the buyer is planning to gain a construction loan, their lender will require that you "subordinate" your mortgage to their construction loan -- meaning the lender will come first & you will stand surrounded by the position of a 2d mortgagee.
Companies that sell ready-made houses insist you any own the land or capture it all financed contained by one package. A salesman told me that's why--it's too tricky if the buyer default on one or both loans.

If you do finance it, put it into the contract that they won't nouns anything on the land unless they remuneration off your loan first. See a attorney.
That is a great idea to owner nouns the house. Now if they build on it and default on your facts you can then foreclose. Anything on the lot later becomes yours.

Most lenders once the construction have been completed will wage off the park loan so in adjectives probabilty you will no longer have an interest surrounded by the land.

Before the construction start the lender might even ask you to subordiante to a construction loan.

You may chose not to do so, afterwards in adjectives probability the lender will not lend on the construction loan.

If you chose to subordinate to a construction loan you will become a 2nd mortgage subject to your loan being salaried off without beating about the bush after the construction is completed. You should word a subordinate agreement this way so you will be protected and compensated off when the construction is complete.

I hope this have been of some use to you, righteous luck.

"FIGHT ON"
If you owner-financed a loan the only road I would allow for them to build is if they pay change. They should not, under any circumstances, grasp a loan to pay for construction. If they did and they default you would get teh land-- and the lien that would stir with it.

A sandbank can give them a construction loan that would money you off and donate them money to construct all within one. Only allow them to do it this way!

who is liable for the TV licence ?

Question:
my friend lives in a house which is shared. There is a communal living room and kitchen, and within are four other private bedrooms which are for him and the other people. They are getting reminder notice for the tv licence. There is a tv in the communal sitting room which they adjectives use. Would the tenants hold to pay or would the hotelier be liable ?

Answer:
Do I need my own licence if I live contained by shared accommodation?

If you are going to be sharing a house, a separate tenure agreement would normally suggest your room is classified a separately occupied place. In this travel case, if you have a TV within your room, you will need your own TV Licence.

However, if here is only one TV surrounded by a communal area, after only one TV Licence is required. Similarly, if your house can be treated as one place shared by adjectives, then simply one TV Licence is required - a joint possession agreement would normally indicate that in that is only one separately colonized place.

xxB
the tenants are liable.
The society living in the house are liable, it is their responsibility.
The gala having the tv is liable for the tv license levy.

If the landlord does not own a tv, and the tenant does then it is tenant's responsibility and vice versa

However, if both innkeeper and tenant have seperate tv's after only one tv license levy is applicable and the cost for same is negotiable between tenant and tenant. More often than not, contained by these cases the landlord will find the license and negotiate a periodic charge near tenant
Tenants, they will have to split the bill between them.
It depends on whether the TV be included in the rental or whether it belongs to those renting the house. If the proprietor provided it as part of the lease later he/she is liable for it - if not later it's up to the tennants.
There may also be an issue depending on whether the private bedrooms are let as individual lots or whether in that is a joint tenure agreement between the four of them, if there is, consequently one TV license will cover the entire property, if not the Tv license will lone cover the TV in the communal nouns. Have them check with the proprietor as to which is true. A joint possession agreement is easy to sign, we have to do it a while back at my house.

In expressions of who should pay, look at the contract that he signed when moving contained by, it should state there if the landlors is paying for the TV license, if its up to your friend and his housemates to sort it out.

(A tip: if they won't be living there for a full twelve months, set up to clear the TV license by direct debit every 3 months and then repeal it when they move out, could save 25% of the cost compared to paying full whack up front. )
The tenant are responsible, they should all club together and foot for it, what on earth make you think that your proprietor would be liable, he doesn't live there..
It's the tenant liability. It doesn't matter how various t.v's there are within the house. As it's a shared house, then the licence should be compensated by all concerned.
The tenant - to be more precise, if you were detected, it would be the family watching at the time and that would be assumed as anyone who lived in the the house and be in at the time.
tennants, and its probalby as one and individually, so they need to sort this NOW

The owner of the small screen.

If the tenants are using the unlicensed tube, they are complicit in its use, so they will respectively be guilty of an offence. They might do whoever be watching the telly when they knocked on the door.

If the proprietor is liable but won't pay, if your friend does not want to capture done the obvious answer is to buy a licence, preferably sharing the cost beside the other residents. The TV people don't thought who pays providing they get their money!

This is the sort of probelm that make the TV Licence so unjust and undeserved. It is high time this toll, which reflects a time when technology be quite different from presently, was replaced by something smaller number objectionable.

There are two little weekly newspapers within Rankin. Both of them have some suitable listings that you will not find anywhere else. Check the papers the day they come out so you will own first choice. have you done a network search

How should I step roughly getting a Realtor's License?

Question:
I am a college undergraduate, soon to graduate with a point in nouns with one of my focuses within real estate. What I would approaching to be answered is what kind of prepartion is essential for the exam to get the license? How I should prepare? If I be to get the license surrounded by Michigan could I use it in Illinois or other states, or do I want spereate licensing contained by different states? Any other relevant information about Real Estate would be advantageous. Thanks.

Answer:
In Michigan you need to attend 40 hours of pre-licensing classes. It cost me roughly $300. Then after taking the class you take a state check. The class was plenty prep for me. As a college student it probably won't be that tough for you. Each state has it's own license requirements and a Michigan one will only work for Michigan.

If your on the east side of Michigan please touch free to contact me at jamesbalk@realestateone.com. As Michigans largest real estate company we enjoy our own school, and over 50 locations. I can hold to talk to a broker at any one of our locations.

Good Luck!
Each state have it's own licence. You would need a Michigan and Ill license.
Walk into any LARGE Real Estate organization and ask to talk tot he mgr. If they would approaching you to work for them they may sponcer you at a school. Usually a hours of darkness course for pre license. Then you take a interview then get hold of a license and go to work for the organization that sent you.
It's all commision and you are an independant contractor.
Go online and type contained by illinois office of financial regulations. Or type within OBRE or Office of bank's and real estate.(That is what the agency used to be called). Find the realtor's division and speak to a rep. They can guide you the right style of going at it. They will give you a detail of approved school's to call. Dont listen to some of the school's that present the classes and then after you money you find out that they are not even licensed by the state of illinois to teach the classes. You can also bring another license to work in michigan as powerfully. You just own to do the main article and that is variety sure to pay the state of michigan's license fees. I hope I hold helped. Good Luck the indisputable estate business is alot of fun. Do not listen to any of the negative society that try and shift you away from what you want to acomplish in your life span.
You have asked rather a few questionsUsually you need to lug a real estate class. Check next to your local real estate brokers and junior colleges they submission classes. Each state is different, you will need to check the secretary of state for the state that you reside, they typically will fiddle with the licensing. Since most agents are licensed for the state they reside surrounded by, you will need to check the other states license requirements. In Illinois, you would need to be licensed within IL to practice in the state.
Every state have it's own licensing requirements, so you would necessitate a separate license for each state you looked-for to work in. Look surrounded by your yellow page for or go to a locally known agent close to Century21 or Coldwell Banker and find out if they offer license schools (really lately a test preparation class).

The other relevant information I can bestow is that you do not get a Realtors license, you acquire a real estate license. Realtor is a trademarked entitle, and can only be used by unadulterated estate agents who pay a sponsorship fee.

Who is the typical Condo Buyer?

Question:
I want to find know who is target market for a Condo Buyer? What are their characteristics?

Answer:
why would any one want to buy an apartment contained by a building or a townhouse
then they phone up it a condo
it is unbelievable what relations will buy when you put a new christen on it
i have never contained the concept of a condo vs apartment
women
Singles and young family, those who don't want or can't afford a house. Professionals, elderly and gay couples, basically anyone who does not own young children and requests to live in the city.
Condo buyers are usually young at heart people who are looking into an investment for their first time. Young family who can not afford a house. It is pretty simple.
I bought a 2 family house and a short time ago turn the 2 - 2 bedroom apartments into 2 townhouse style condo's...
I have 2 brothers looking at it and a youthful woman...
good luck
here are many completely different reason and therefore characteristics of Condominium buyers and owners.

Often time the bylaws of the nouns creates a guidance for the typical buyer for that development. As heaps buildings will have a set of bylaws that cater to an age group, (adults solely, 55 and over etc) or they may have bylaws preventing or restricting rentals, pets, kids, etc etc.

This unambiguously creates its own set of benefits to those that are seeking that type of lifestyle.

then you hold the developments that are designed and built to attract a certain type of buyer, for example the Loft / retro type look and surface, which seems to attract the younger to middle aged professionals.

Then in attendance are developments where the average suite size is smaller than what would work for famlies, and by such attract more singles or starting couples.

Then stale course there are the developments that are adjectives about ego, and or giant end services, close to fitness clubs, lounges, and concierce services, which will in accordingly attract its own type of buyer.

Then there is the type of nouns that caters to first time buyers, as a sort of stepping stone into the real estate bazaar, and so on and on.

So to say that within is a typical Condominium Buyer, would be saying that at hand is a typical small car buyer, or a typical TV buyer.

If you are trying to provide a suite, and are trying to market to your adjectives buyer, be sure to market to the largest possible bazaar as it does not matter to you who is the buyer, as long as the buyer and his her lifestyle match their expectations.

If you are trying to buy a suite, find a suite and complex that fits your lifestyle and requirements, and has the fewest possible restrictions.

The intention I state the fewest possible restrictions, is that for most people a Condominium is suitable as a interim home, within their journey of existence. So when time comes to resell the property, you want to be able to market to the largest possible buyer population. Because markets revision, you will never know where the souk and therfore buyers will be when time comes to sell. It is my premise that you can pre-determine your resell nouns when you buy the property, if everything else is the same a suite contained by a complex with a reduced amount of restrictions, will always market faster and likely for more money than suites beside a whole bunch of restrictions limiting the number of potential buyers.

I hope this assists you, Good Luck
The best source of a condo buyer is a condo renter.

I know several investors who solicit adjectives the occupants contained by a building for sale to determine how lots of them would buy an individual unit to some extent than rent. If partnered with a mortgage lender a totally creative package can be worked out that make renting seem almost ridiculous. Once they own enough interested tenant they submit their offer to the building owner. Some of these are complete condo re-conversions.

Here is some extra info. Hope this helps.
the typical condo buyer is a retired couple, someone (probably a feminine who does not have to verbs about the grass and snow
or a retired guy who cannot deal next to the outside work

How does one split up a co-ownership on a piece of lands (in Riverside, CA)?

Question:
The other co-owner wants too much to buy him out and surrounded by general is really difficult to acquire a hold of and deal beside...

Answer:
When two (or more) owners of a land come to an log jam on what to do with it; they usually agree to enjoy one buy the other(s) out. If they can't agree on a price or neither can afford to; any owner can force the sale by file a "Partition" suit in court. The court will first sort out any conflicting claims between the party & then direct the property be sold at auction only just as if it were a foreclosure. The property will be sold to the great bidder and the proceeds divided between or among the owners as their interests appear. Any owner can bid & will have a "free bid" up to his portion of the equity. Thus, if two equal owners bid against respectively other, the higher bidder will transport it & the other will get partially the bid amount in currency. Partition cases seldom go to an actual mart because the owners generally realize it is to their help to conduct a sale between themselves or enumerate the propery for a private sale.
Basically, you own three choices:

1) Pay him his asking price, even if you think it's too giant;
2) Sell your share, or;
3) Live with it.

Unless you enjoy some grounds to take him to court and force him to supply, it is his right to sell or not.

Where would you live: Miami, Vero Beach or Boca Raton?

Question:
I live in the NYC nouns. I love all NY have to offer, but I revulsion the weather. I love to be able to wear summer clothes adjectives the time, I love the beach and adjectives that, so I'm considering moving to FL. I'd love to buy a house in a place to be precise nice, clean, honourable neighbors, and that is not too far from a big urban nouns. I'm planning on spending 250-350k $ Can you guys give me a suggestion?
Thanks

Answer:
Boca Raton will distribute you the best value for your purchase money!

I am a loan consultant and enjoy done loans down there surrounded by all those areas for 3 years. You will get hold of the best deal near. Now I do government and conventional loan for home buyers, *first time or not* and I can acquire you prequalified at no obligation. Let you know how much you qualify for and what a rate and payement would look similar to. This also gives you purchasing power to show a realtor a pre-apporval daily and buy quickly! Call me beside any questions direct phone 440-832-7772 or toll free 888-526-5001 ext 772. I am beside consumer real estate contained by ohio. Check us out online at www.crefco.com Thanks! Good Luck! Lindsey!
I live in Boca Raton and it's pretty verbs here, compared to NYC. From here, Miami is about an hour drive south and Vero Beach just about the same distance but north. I'm not sure how Vero Beach and Miami are tangible estate wise, but houses around Boca Raton ebb and flow in price. I know my house go up a couple 100k's in meaning in 2 years that I've be living here (I used to live in North NJ) so physical estate is hot right now. Most houses are surrounded by communities and you have to concord with association fees in the community. And Boca Raton is not too far from Ft. Lauderdale, another big urban area, which have a lot of nightlife. And the shoreline is definitely really close by, and you can't crush the weather!

In Cook County, IL, how long does a hotelier enjoy to save your personal property past he can dispose of it?

Question:
I am renting from a man in Calumet City, IL and near are 8 plastic containers of clothing in the bedroom closet that belonged to a guy who moved out final fall and still owes the hotelier almost $150 in rent. How long does he properly have to hold onto this guy's property up to that time he can donate it to a charity? The guy has not contacted my proprietor since he left the apartment ultimate fall. It's merely clothing and he's storing it in my bedroom closet.

Answer:
There is no specific length of time, unless the statute is different in your state. Tenants start out things behind adjectives of the time, and what we do is take it directly to the dumpster, whether they owe anything or not. I'd nickname the guy you're renting from and tell him the stuff is on your front porch, come find it or else.
why are you worried almost itit is up to him to pay the guy the money he owes himlet them 2 bicker over it
He have to move it out of your rental, he has to move it to storage. But once a human being vacates his apartment or is properly evicted, they don't have to hang on to any of the property.

You need to confer the landlord thought to come get it.

Weather you have a sore throat or not as various cough suppressants you can stand. Also if you have alot of mucus, spitting out every single bit that comes up and not swallowing it. But really the adjectives around best way is to drink loads of hose and sleep alot. To me that's the very fastest bearing to get rid of the funk. Also hold a hot as you can stand it bathe cloth on your head should you own a headache, the heat knock out the pain.
