Can a Land Lord Rent an Apartment to Someone Under 18?
Question:
Are there any special requirements/ restrictions? Anything else I would involve to know?
Answer:
You can rent an apartment; you just necessitate a co-signer for the lease.
Like other people said -- you're not prehistoric enough to hold your signature mean anything. You can sign doesn`t matter what lease you like, and nobody will hold you to it. Thus...unpromising idea for the innkeeper.
"If you’re 18 years old, you’re allowed to sign a lease yourself. For tenant under 18, landlords usually ask the parents (or tutor) to sign contained by their place.
Why? Because a minor doesn’t have the right to sign a contract close to a lease. So the alternative is to ask his parent or tutor (this just manner legal representative, not the soul who helps you do your math homework!) to sign for him.
There may also be some “borderline” cases where on earth a tenant is almost 18 and can afford to pay his own rent. If such a situation wind up before the Régie du logement, it will be up to the tribunal to agree on whether the lease is valid depending on the circumstances. In general, though, minors contained by these instances have be considered to be capable of signing a lease.
Besides that, the lone people lower than the age of 18 who can sign a lease are those who have be “emancipated”. This means that a court have granted the minor the right to fully exercise his civil rights just close to an adult, resembling signing a lease, making a will, initiating legal proceedings, etc."
(from http://www.educaloi.qc.ca/en/jeunes/civi...
I be one of the above-mentioned 'borderline' cases and got a lease at 17; it does begin. But not without some hassle.
Yes, and it's call "entering into a contract with a minor".
Bad hypothesis for the land lord.
You can, but I wouldn't.
In most states, anyone beneath the age of majority (18) can not be held to signed contracts.
If you rent to him/her and they decide to lift a walk after that, you would be out the rent money, unless you could bluff them into paying.
No, a minor can not enter into a rental agreement. The only route you can is to become legally emancipated, which requires a settle.
If somone give you power of attorney are you responsible for adjectives near bills?
Question:
I am in a situation my husband will be departing the country soon and i am getting a divorce the house is in both name but the mortgage is in one and only his name. Is their a broadsheet he can sign giving me property or power of attorney?
Answer:
NO
It will depend on where you live, to be honest it's best to bid an atterny and get a proper answer.
yes,
but he can control your powers as he wishes..
Iraq? Divorce?
Some woman!
If he give you DPE you can sign his dub on all doc resembling the sale of the house
Yes he can if he wishes to do so and you are just responsible for paying the bills if there is plenty money in the side and if you wish to do so.
a power of attorney can present what you want it to give, but I don't see why him ;eaving the county would build him unable to recompense the mortgage. It's called U.S. Mail, or PAY PAL Online. But it doesn't appear like you would stipulation his permission top brand a payment on the house for him. Are you really tryinmg to steal the house?
my future ex wife would be the concluding person I would offer power of attorney to, but there are 2 different types of POA. One is a special power of attorney, and it applies to specific items, so if you want to put up for sale the house he can give you special power of attorney to perform in his autograph ONLY to sell the house. You wouldn't know how to legally flog his car for example, or bear money out of his account properly.
A Power of Attorney is only a document stating that you can deed in his place as him, it is primarily used for military family when a service member deploys and the spouse may requirement to do something at home. Having a power of Attorney does not make you liable for his debts, it with the sole purpose states that you can act within his place if the place you are using it accepts the Power of Attorney.
There are 2 kind, a Specific and General, a general give the power to do anything with the personage name as if you be them, a Specific is made up to state specift things that individual is allowed to do. All of this is dependant on weather the place you attempt to use a Power of Attorney at will acept it, there is no court requirement that they must accept you using it. Hope this help, Good Luck.
Absolutely. See your attorney, it will have to be initiated by him/her anyway. Make sure it give you what you need. A poorly worded POA can be challenge easily surrounded by court, must be very specific.
Yes , Coz He/ She work on behf Of u& its method that u agree on this perpuse [ work]. POA & its everywhere any cuntry. same as
yes he can give you power of attorney and yes you would be responsable for bills . at most minuscule thats the case beside my mother in ruling and her elderly father
Power of Attorney means that you can lawfully sign for him in any concern that he gives approval for in the POA. Since you are getting a divorce, it might not be contained by his best interest to do this. He might be able to verbs the house to your name if the mortgage company agrees. After adjectives, they don't have title but they if truth be told own it until the mortgage is paid past its sell-by date. If you both agree to sell the house, he could administer you POA to represent him in the mart and specify what to do with his partly of the money left after mortgage and expenses are rewarded.
Yes, there is a rag you can sign, but it is not a POA. It is called a Divorce Decree and Terms of Settlement.
I must voice that you are in a hugely unpleasant situation. In my opinion you must ask for legitimate advise.
If your husband is departure the country for good yo must see that adjectives official documents you will be need in the adjectives are in writ.
If you intend to sell the house contained by his absence but near his consent you have to obtain a legal power of attorney declare this clearly otherwise you will be in trouble
In the meantime you can still compensate the mortgage,if this is in your interest to do so.

is it possible to revise unit contained by your apartment bulilding if the one that your currently surrounded by is not suitable?
Question:
ive just only just moved into my own apartment at the end of october 2006 and every since i moved contained by i have have nothing but headache the first day that i moved surrounded by the apartment unit that i be told that i was going to be living contained by they change it to another component that was a total dump!! the mat was hurtful with grades all on it the walls be not painted broken kitchen drawers stove not working properly dishwasher comes out the wall windowpane wouldnt lock mildew and the first month that i was in that my bathroom celing started leaking and i a short time ago wanted to know can i request another part immediately and save can i break my lease without human being liable or if all fail could i just shift to another apartment and try to move there up to that time i get a doomed to failure name from the apartment that im currently at
Answer:
First of adjectives, they are not supposed to pull a "bait and switch" on you. What part is specified on your lease? If it is the other one, you probably have an out.
If it is this one, its for a while harder. Start by photographing/documenting each problem contained by writing, and send a certified note to the landlord requesting these items be repaired. Depending on your state, you must bequeath a "reasonable" time for the landlord to correct the issue, usually 30 days. If after that time the repairs are not done, you may hire someone to do the work and take off that amount from your monthly rent. BE CAREFUL! Do not deduct rent minus checking the Landlord-Tenant act contained by your state, or you may be charged late fees, etc. for deduct rent. Also, you can't deduct for things resembling the apt. being dirty, but issues that affect its habitability are ok (heat, stove, plumbing leak, etc.)
yes absolutely possible.
You should bring within someone from the leasing office to look at everything you see. That opening you have shown them evidence that your apartment is horrible. I am not for sure around the lease part you might want to check your lease agreement and see what it states on breaking your lease. They should at tiniest move you into another unit and fix the one you are within before they rent it to another tenant

A real estate attorney can do that for you for a nominal duty.
Should I choose Republic Bank or a Credit Union for a Mortgage? How enjoy your experiences be?
Question:
Answer:
I went next to a Credit Union over a Bank. Their closing costs were significantly lower for like loan terms than a edge.
Credit Unions Fees and paymnet schedules are much better than any mound I've seen
It depends on Credit. As anything beside borrowing money from a financial institution. A credit Union may have lower costs (origination, Closing, etc.) that is to say because they are going to make their money past its sell-by date the interest on the loan.
A Bank may not have as well-mannered of closing costs and so forth but they more than likely can win you a better rate.
A mortgage broker has the power to find you the best possible rate and works with abundant different lenders so they can cherry pick and get you the best promise. No with a mortgage broker your closing costs, origination fees, etc will be sophisticated BUT that is adjectives rolled into 1 payment and 99 times out of 100 the street trader pays closing costs.
So I guess the real press is do you want to pay a difficult Rate or lower closing costs? Higher rate means more money surrounded by the long run and the extra $1,000 you have to repay at closing is now a drop surrounded by the bucket compared to the .5% higher rate over 30 years at the credit alliance.
So3503...you are a liar. Mortgage companies are unregulated go-betweens for investors similar to Ford Credit and General Electric. The higher interest rate you can flog, the bigger your commission check! GET AN HONEST JOB, YOU CROOK!
Banks and Credit Unions are your best bet. Right now, alot of them are selling 5-year mortgages and after the rates will change (balloon). Check beside both of them and compare closing costs and availability of Fixed (ve. balloon) loans. Good Luck!
House contained by non-attendance...?
Question:
How long before we enjoy to move out? Can we move out now? Also, do you notify your mortgage companies so they can speed up the inevitable foreclosure? There is no abiding our home, so please, only answers to my question.
Answer:
Some users have made excellent suggestions. Also reach a deal to Realtors to see if they can help you put on the market the home. If you foreclose, your credit will be shot.
If this is your primary home, talk to an attorney, if selling, or stopping the foreclosure is impossiable; Chapter 13 may recover your home.
Call a lawyer very soon, if the mortgage holder sells your home for smaller quantity than is what is owed, you will be served with what is call a "deficency letter". This means that you will still owe the go together.
Say you owe $125,000, and the bank sell the home for $110,000 you have NO HOME and still owe $15,000. Call an attorney in a minute.
I will humbly disagree with your statement that in attendance is no saving your home.

If after going to the suggested association above there is still no hope afterwards I suggest you offer the lender a creation in lieu of foreclosure within an attempt to at least pick up your credit.
Normally you have to be 90-days former due for the foreclosure process to even start. You can contact your lender and tell them that you are moving out and that they can enjoy possession of the house as soon as you move.
1. Make sure you have an excellent attorney.
2. While consulting the attorney ask around the possibilities of selling the home. You may be able to put on the market it quickly and label enough to settle alot of debt, put aside your credit, and even walk away beside some money ---- maybe.

Where is your home located? I may know how to help.
It would be nice to hold all those professionals helping you, but I mull over it would be better to reserve the cash to preserve a roof over your head. I would suggest that it is contained by your best interest to sell the home, to some extent than leave it to the lender. You are obligated to compensate the amount you borrowed.
Even if you sell the home for smaller quantity that what you borrowed, you are minimizing the amount of money you own that lender. So instead of owing say $500k, possibly you can owe them $50K.
Understand that if the lender repossess you owe all those repossession costs (a considerable amount). But the worst problem is that once it is reposed the lender in a minute calls the shots. They can want to keep the property on the bazaar in hope of getting the utmost possible price. Prices could fall. And you are still responsible for (the full amount of the loan + loan & repo costs – anything they sell it for). You could be up on the hook for a much better amount, especially in a deteriorating market.
As far as moving out, first I’d suggest good your money for first, last and protection. And stay in the current house as long as you can. I’d suggest getting an off-site storage and moving the majority of your possessions in attendance. When the Marshals show up they don’t let you thieve much. Technically that house and everything in it belongs to the lender.
Also you might want to prearrange your crash wipe (where you are going to go quickly after eviction but before you can gain into a rental.) I think this is the single biggest mistake masses people construct. Not having a plan, they progress to a hotel and burn up the money they need to attain into a rental. Then they are homeless, and from there it adjectives comes apart jobs, loved ones.
Sorry for your loss.
Every Bad thing that happen contains the seed of a greater honourable, all we own to do is search for the opportunity and cultivate it. I hope you come through these difficult times to wallow in future prosperity.
It sounds resembling you just get into a bad situation and hold decided to bequeath up on the current home, repair your situation in the adjectives, and make sure you can live affordably. Is that accurate?
If so, the timeframe for staying surrounded by the house and waiting out the foreclosure process is determined by state law. I couldn't find out what state you live contained by by your question, so you might want to look up foreclosure law in your state. That will contribute you an idea of how much time you hold, from foreclosure date, to sheriff sale, to eviction.
Some states propose redemption periods, where on earth you can stay in the house for a spell of months and attempt to purchase the property back, refinance, market the house, or just find somewhere else to live. But the dune wouldn't be able to see you out until the redemption period expired.
You can move out immediately, if you have somewhere else to move about. The foreclosure process probably won't go any quicker, but the sheriff may swing the locks on the house, just to hold out looters since you are abandoning the property. But the process of foreclosing won't progress any quicker.
You might be better off taking dominance of the situation to save up some money, or breed your current situation better again. Failing that, just put away some extra money to establish an emergency fund, foot off other bills, etc. Then move when you are contained by the best situation that is realistic, under the circumstances.
Good luck.

Technically you do not hold to move until the auction has completed. Even next you might find that they will not evict until a bit later if the edge takes the property support.
If you want to speed things up you can agree to hand the property stern to the lender. They do not need to adopt and there are some dutiful reasons why they will not. Or they might adopt the deed. Your attorney can share you how the process works. Deed in lieu is the phrase. It can be slightly smaller quantity negative on a credit report so in attendance is an advantage to you if they adopt. The key apology they will say no is if in that are junior liens that they want wiped out through the foreclosure process.
You can move out at any time. You might want to move sooner as your credit might be in better shape impulsive in the process compared to belated in the process when more things show up. That can minister to when apply to rent a property.
If you have other question feel free to find in touch. There is no artifice but you seem pretty natural about the option at this point.
You may have a right of redemption base on the state. This means that after the auction is over you still enjoy time to show up with the full amount owned plus adjectives fees and other costs so you can redeem the property. Something to know about but not something that sounds probable to matter contained by your situation. Just be aware in bag something significant changes within your financial future.
Deed within lieu of foreclosure not hurting your credit is a myth. It will still hurt your credit, just not as much. Offering work in lieu of foreclosure would supporter you a firm move out date. You can just move out presently if you choose to do so. You are under no duty to stay there and if you are prepared to move on I would suggest doing the work in lieu of foreclosure.
If you don't do this The sandbank will proceed to foreclosure and usually the house is offered for auction on the courthouse steps (depending on your state). If no-one buys it the bank may extend you cash for key, usually just a couple hundred dollars. If you thieve that you usually have a few days to move out beside all of your possessions departing the house in alike condition (don't trash it). If you don't take it they will evict you. If within really is no saving it you do own some time to move.
Either way your credit is hurt and if a short Dutch auction is not possible afterwards I would suggest you start looking for a place to live now. Your credit will get better in several years. It is a miserable situation but it is happening more and more every sunshine. Best of luck to you in the adjectives.

I help someone refinance, do I still qualify for a first time home loan?
Question:
I helped my parents refinance their home a few years ago, and in a minute I want to buy my own place. Will I still qualify for a first time home loan?
Answer:
You can still qualify to buy your first home. Actually, if your parents were consistent near there mortgage payments you can even procure something better than what first time buyers get on conventional loans.
There are three types of programs for first time buyers:
1. Down donation assistance programs form your local governments and charities. These are typically for low-income citizens or neighborhoods and can only run up to certain amounts
2. Government sponsored loan from lenders. These are FHA type loans that can be used along near down payment assistance loans. Again, these are restricted in theire freedom.
3. Conventional first time buyer loans. These are usually more flexible than government programs. they can progress to 100% up to $1.1Million without have to qualify for any assistance. Not all lenders do these loans and they usually come beside lower rates.
You, on the other hand, can qualify for loans that you generally wouldn't be able to because technically you are not a first time buyer. The loans that you can catch will probably be better than you would have gotten otherwise.
Call me if you'd similar to to see how much you qualify for and what your payment would be. My phone number is 818-361-8585 (Just ask for Kevin)
I do notknow myself but if you nickname Aslam Ansari. He is the only creature I use for mortgages.1 917 602-5942 tell him Tom give you the number. He is very knowledgable .I hope it help. Good luck
No.
Is there a first time home loan you hold found? It's states and counties who offer benefits for human being a first time homebuyer in their nouns. Talk with your Loan Officer and hold him/her contact one of their Title company contacts for an accurate explanation.
What is a due diligence when it comes to (buying and selling homes)?
Question:
Answer:
Due diligence implies that you hold ascertained everything that has to do beside the property, the deed, and your purchase/finance jargon.
doing that which a reasonable prudent entity would do in a similar to or similar circumstance. If your an agent doing that which a reasonable prudent agent would do surrounded by a like or similar circumstance. Applied to adjectives acts involved within the buying and selling process (i.e. buying a reasonably prudent individual would get an inspection, selling a sensibly prudent agent would ?)
It means don't doddle around, or ASAP. So if you trade name an offer both agents must try to to return with it into the sellers hand fast, or if the purveyor counter an offer it must be given to the buyer hasty. This is so the the seller can't skulk around for other offers, the the buyer can't manufacture other offers.
It way doing your homework BEFORE you make a commitment on any side of the transaction.
Due dilligence is basically following up within a reasonable bearing with adjectives pertinent information that must be communicated between the buyer and seller through their agent. The rank of due dilligence depends on whether you are being represented by a Buyers Agent or are lately the customer of a real estate agent whose contract loyalty lies beside the seller. If you are not represented by a Buyers Agent or an attorney and use singular the real estate firm who is showing you houses; realize that even though an agent may be working with you on the purchase of a home, that individual is still an agent of the seller and must feat in accordance beside the boundaries of his/her obligation to the salesperson.
What hassle come beside renting out a self-contained suite (separate entrance) attached to your own house?
Question:
And, if you live in something similar to that, I'd love to hear what you think of living so close to your tenant; what the problems are, etc.
Mind, if anybody wants to discuss the advantages, consistency free...
Answer:
I live in the bottom partially of one of my rentals. There is a 2 bedroom apt upstairs with a separate entrance.
It depends on the type of relations you put in in attendance. If they have kids, expects reverberation.
Even if its carpeted, you will still hear them walking across the floors.
You will hear every arguement they may have.
You can even hear them shower.
Plus you hold to try to be quiet too. And they can hear everything you do.
The one and only REAL advantage is I win my rent ON TIME. They cant say it get lost in the communication.
The only benefit would be the rental income, and perhaps reunion some new friends. The hassle could be many, and some could be serious- they may not settle up their rent on a timely basis or at adjectives, excessive noise, they could be slobs and trash the place, they could smoke and smell up the place or burn the house down.. and within most places it's extremely hard to evict general public even if you have fitting cause.
the problems are dealing near people. we adjectives think we are right and conceivable. there fore if in that is a problem, the other person cause it.
i have be a landlord multiple times. you proximity now and then is an issue unless you want to micromanage.
to get biddable renters is very trouble-free.
get tne phone number of the current home lord, and trhe number of the prior landlord.
you telephone call them both and ask the same give somebody the third degree. would you rent to this person again.
listen to what the current innkeeper says, but don't put uch stock to it. a proprietor will iet to get rid of a bleak tenant, and to keep a dutiful one.
the prior land lord is the push button. they have no ax to grind.
deposits and prepays are up to you.
using this formula i don't call for to take deposits.
i set a rent substantially superior than i want, then utter of the rent is paid since this date each month i will grant you a x$ credit.
when someone can save a bunch of money by paying prompt they do.
the courts will uphold the higher amount of rent, if you enjoy ot go to court, but on the odd occasion give behind schedule fees.
i have rented rooms within my house, a duplex ahd houses, and have lost money on one and solitary one tenant with this formula.
if you do unit 8, put in the contract that adjectives rent money is to come directly to you, and if that doesn't happen it is grounds for IMMEDIATE eviction. this too is legalized.
if the tenant changes the agreement, and you don't capture the money,DO NOT agree at all, a short time ago call the marshall or sheriff for breach of contract and eviction.
