Lien on a house............?
Question:
I recently placed a lien on a property for a personal loan of $50,000 because the character didn't follow through on a written agreement. My question is can I win my money back if the house go to forclosure and is owned by the bank but the lien is reflect on title? What is the procedure for this?
Answer:
I do not think you can find your money back if the home is penniless. You only obtain your money back if the owners put up for sale the home.
If the home is valued at $500,000 and the bank is owed $300,000 and consequently it sells for more than what owed to the mound then you will procure your money back.
However, if guard does not recoup nearby money neither will you.
First Trust Deed gets compensated first then any other Trusts - I believe liens are closing on the list of getting remunerated.
Best of luck to you.
I doubt your lien will be considered valid.
That's like a credit card company putting a lien on your vehicle.
Unless you agreed to specific collateral at the time of the loan, you can't just travel take it then.
Good luck with that. Go find an attorney.
First of adjectives you never ever want a lien on your house !
Some houses will fall over if the lien is too heavily built and pushing on the sides of the walls especially old houses that own a bad foundation !! See a professional house mover for more
suggestions !!
Your lien is probably not valid for the function that I don't see that the loan is related to the house. If you have no interest contained by the title, you aren't going to be able to place a lien against it. Furthermore, if you don't safe and sound a lawyer and directory a claim against the borrower, when the house is foreclosed you will still be unable to breed a claim against it. Buy filing a claim, the court have a right to consider ALL property and funds attributed to the defendent, hence the title may not be free and clear, forcing the home lender to consider settling so they may liqudate the property legally. If you involve the house at hand is a better chance of a settlement. If they directory for bankruptcy you will own to file as a creditor to want protection. The judge/arbitrator will review your claim and determine if you are a valid creditor and if the filer is liable to resolve the debt.
This is rather life-size a deal to toy with without nouns legal warning. Seek it immediately as whereabouts can be swift and serve to smash your plans and wishes...you need to conduct yourself now.

Or there's an unsightly stain in your living room hearth rug. These aren't huge problems, but you don't just own to live with them, do you? The answer depends on the humour of the problem: Your landlord is responsible for keeping your element in a livable condition but is not required to receive purely cosmetic repairs.
Is near anyone know which slice of california have accurate school and housing price comes down deeply not long?
Question:
Answer:
Fresno, Ca or Madera, Ca
There are some new homes that I saw advertise and they were motto no reasonable proposal refused or construct an offer. That be something I'd never seen up to that time. But these builders built big when they saw the market climbing so nifty - a few didn't get surrounded by on it as their projects didn't get started within time - now they are contained by trouble - paying monthly on a construction loan is more expensive than a home loan, the interest is a lot stiffer.
Fresno have lots of nice schools. I'd suggest you contact Fresno County Superintendent of Schools and ask for suggestions from them. You can also check school at the website listed below - they rate them.
During the "price rush" which last about three years here = three fresh homes were built on my block - adjectives sold for over $500,000 - about 4 months ago a house on my block sold for rather over $300,000 = during the price rush this home would have gone for just about $125,000 more than it actually sold for.
Now here are several homes for sale within my neighborhood, one of them it one of the new homes that be built.
Best of luck to you in your query.
You can search homes, and see pictures and descriptions of them at www.realtor.com you only plug in what you want surrounded by a home and they will list those homes single.
Fresno, Ca There is a lotr that we dont know about but you can check next to ca realtors.com
From what I have hear,I might check out Merced,California,If I was looking to be within California
Housing prices will never come down in California, anywhere within California.
You have to be thoroughly rich and live in a particularly good neighborhood if you want apt public schools.
Is Cali merely a consideration, or are you moving here for sure?
What part?
If you are looking for a nice state, Colorado or North Carolina would be better to look into.
The best school are in Irvine and Aliso Viejo, California.
The prices come down, but not a lot. I do not devise the prices in this nouns will go down much more.
The school and quality of life span is important, we enjoy to pay for such things.
I live within Irvine. My granddaughter is in the 3rd class. Her school is public, but better than a private one.

Why do culture can`t bear realtors?
Question:
of course, we adjectives hate individuals who steal, cheat or otherwise are ethically or morally-challenged. but the actions of a couple of ethnic group shouldn't taint the entire profession, should it? it's approaching hating lawyer, hating police, hate mother-in-laws...
i understand if you've have a bad experience beside a realtor, but what about the rest of you who don't even own a house?? what's up near all the revulsion??
it's monday...
Answer:
6% for doing very little bar listing a property.. is one big motivation..
However, they are taking a risk and it costs them monthly to be a part of the local MLS. So they enjoy to charge for the work that they do. Many people of late feel that the rate is not appropriate for adjectives occasions.. The highly developed the cost of the house, the more the Realtor gets for doing like job. Of course the cheaper the house.. capably you get the concept..
As for the others.. well Lawyers become politicians.. and we see how our Government is presently (BIG SMILE).. Doctors are considered excessively greedy now.. And probably a moment ago about any profession is any too easy, too tricky, too much money for the work done, and they were simply plain lucky to get that career or position :).
Frankly.. most of the time.. it is simply because people follow a trend or really a troop mentality and just be in motion with what have been told them, minus thinking about it themselves.
I am a Realtor surrounded by Oregon and I think much of the idea toward realtors comes from the actions of some (many) years ago. Realtors used to be equated near used car salesmen (sorry!) Fortunately in attendance are many more law and requirements for Realtors now which reduced the number of complaints. One point I do know is that the number 1 complaint about Realtors is that they don't stay contained by touch with their client. This is especially critical to sellers when they are not have many showings of their home. Realtors requirement to discuss the situation with the seller in an honest straight forward deportment. Most important is that Realtors MUST own their clients interest at heart. Once a Realtor puts their clients interest after their own, they are no longer effective or beneficial to their client.
Just a short sentence as an ex-real estate sale representative
-- I got out of the business after a year, because it took me
that long to realize that I be an honest person -- I AM ashamed
Well I'll make available you my opinion.
People who don't twig why things are done by licensee's as required by law and rules and regulations and due to them not have those same levels of specialized teaching have a drift to react not a predilection to understand.
I'll use this analogy, although crude, it will craft you think.
Along comes the missionary and he lands on a foreign parkland never visited by civilized man and on the shoreline he sees a aboriginal bringing him a plate full of cooked human body parts. What do you think the counterattack of the missionary will be and what do you think the criticism of the native is going to be to the missionary's criticism. Will either of them be right within their reaction?
In any event citizens react to what they don't know is the norm contained by the opposing party's demeanour. That is my opinion and resembling lawyers everyone have one and you just get mine.
Because they do hardly anything for the crazy amount of money they bring. As housing prices goes up so does their fees, and they're not doing anything more. Sellers approaching myself resent it. There should be cap.
I'm sure near the internet--more and more of them will be squeezed out. Good riddance.
I'm selling my own property, and I will hire a lawyer to do adjectives the legal and paperwork.
Why? BOYCOTTING.....this doesn't only just happen surrounded by Tulsa, either, it is much more extensive....
Feds Probe Boycotting Real Estate Agents
Money Magazine
April 22, 2005
By Jon Birger
NEW YORK (CNN/Money) - Did you pay your concrete estate broker too much? The U.S. Department of Justice may be set to turn Tulsa, Okla. into a test-case for ending the stranglehold 6 percent commissions own over the real estate brokerage business.
MONEY have learned that Justice's Antitrust Division is assembly information on the bully tactics that full-commission brokers surrounded by Tulsa allegedly use against their discount rivals to discourage commission-cutting. The probe follows other recent pains to spur competition in the solid estate industry.
According to a copy of a Justice Department subpoena obtained by MONEY, federal investigators are seeking information on "possible anticompetitive conduct surrounded by the provision of real estate services surrounded by the Tulsa area" as well as "documents related to refusal to cooperate on indisputable estate transactions."
An Antitrust Division spokeswoman confirmed the existence of the investigation but declined to provide second details. Al Unser, executive director of the Greater Tulsa Association of Realtors said: "We received a CID [civil investigative demand] from the Justice Dept. and we have responded."
Economists who study indisputable estate, such as the University of Cincinnati's Norm Miller, believe anti-competitive behavior is the primary explanation for the persistence of the 6 percent commission. J.D. Smith and Bob Meyer are two Tulsa discount actual estate agents who say they be interviewed by federal investigators. They say the investigators looked-for information on full-commission agents' alleged refusal to show home-buying clients properties listed by discount brokers -- a tactic prearranged as boycotting.
Boycotting exploits the one major fearfulness of the multiple listing service. The MLS's upside is that it centralize all homes for Dutch auction in a single electronic bazaar that can be accessed by adjectives agents -- and these days by Web-savvy consumers as resourcefully. The downside is that brokers must depend on one another to help deal in their homes, and that discourages them from undercutting each other's commissions.
While boycotting the listings of discounters is mostly considered an antitrust violation -- if undisclosed, it's also a breach of fiduciary duty to clients -- industry insiders are ably aware that boycotting goes on, even if they claim not to condone it.
For Smith, the Feds' investigation comes a year or so too postponed. His realty business on the brink of ruin, Smith recently discarded discount brokerage and went posterior to charging 6 percent. "In one week," Smith said, "I've had more showings and more offer from other realtors than I had contained by the previous two months."
The Tulsa investigation is part of an ongoing Antitrust Division foray into the sharp-elbowed realty world. In March, the Antitrust Division sued the Kentucky Real Estate Commission over a state statute that prohibits real estate brokers from offering commission rebate to consumers.
More recently, Assistant Attorney General R. Hewitt Pate sent parcels to lawmakers and regulators contained by Oklahoma and Texas, urging them to reject proposals that would effectively prohibit brokers from engaging contained by limited-service or fee-for-service realty -- such as listing a home for mart on the multiple listing service for a flat allowance of $500.
Bruce Hahn, chairman of the American Homeowners Grassroots Alliance, argues that state prohibitions on rebates and fee-for-service discourage competition and inflate commissions remunerated by consumers. "We've talked to Justice, and we reflect on what they're doing is tremendous," he said.
Tenant have to own content insurance?
Question:
Should I have included on my lease between myself (owner) and my tenant that she must enjoy her own insurance for contents of the house. Someone just told me that, and my lease didnt hold it. She hasn't moved in even so, her move in sunshine is the 1st, can I still add it? How? What if she doesn't hold it, can I just hold a clause that states I am not responsible for content insurance? Help me!
Answer:
Most landlords don't require it so to remain competitive I wouldn't require it but I would add an PS indicating that tenants should inquire beside their insurance provider about renters coverage. I wouldn't supply the clause re: responsibility for content insurance because the insurance covers more than contents (ie liability).
i don't ever remember having anything approaching that in the lease that i've had - you could newly mention it to the tenant - landlords are responible for the maintenance of the property and not the contents
I would convey her a certified letter stating that while you don't require renter's insurance, it would be to her benefit to find some because your home insurance does not/will not cover her belongings. That way you aren't responsible (unless obviously there is a problem near the house that isn't her fault) if she creates a problem and ruins all of her belongings.
Living within an RV?
Question:
Okay. My fiance and I are getting married in June. We are really thinking in the region of living in an rv for a year or two. We love the outdoors, but we aren't doing it so much for travel...we want to do it so that we can wages off debt, free money for a nice home one day, and next have something to stir camping within for the future. Has anybody lived contained by an RV before? Is it "doable"? What are the positives and negative? Will we really be able to let go alot of money?
Answer:
It depends on how much you make, how much you are going to spend on the RV, how much you will enjoy in space rent, does it include utilities, etc., etc..
It is doable. I know some couples that own sold their homes and now RV full time, but they are retired.
Some RV parks (especially on public land) do not allow "long term" space rent, but privately owned parks most do.
The walls tend to "close in" and living together within such a small space may get taxing. However, the craze spending and such will be greatly dimished, as your storage space will be very low.
I know of a couple who lived within an RV for about 2 years. She detested it after about 1 year. The space is unbelievably small and you hardly enjoy storage. My advise is to craft a budget of how much you both earn and what your expenses are (e.g. credit cards..). You might want to look into renting a condo as they often include utilities.
Hey darlin', damn straight, RV's are the passageway to go for the short occupancy, semi long term or whaterver. I'm single, & for the better fragment of ten years, I've been using my Rec-V, that rimes near Debt Free. Do'nt owe anyone spit. Definitely doable. Go for it honey, you won't regret it. Take care.

Would I run through an agent, or is this type of info in the weekly?
Answer:
Contact a large genuine estate company. Work with an agent. Agents are compensated by owners of the buildings, not you, so why not have a professional work for you?
Just ring up several large existing estate companies in the nouns you want your office to be (Century 21, Prudential, Coldwell Banker, Remax, etc.) and explain to them what you need. I'm sure it will lift a couple of calls to find an agent.
Do NOT listen to population, who tell you to be in motion on some web site, or look contained by the paper. Even if you find a place yourself somehow, do not approach them. Get an agent and hold him or her contact the owner. Let a professional negotiate and execute the lease.
I've seen population asking all kind of questions here on Yahoo around this, so they seek insist on from strangers and not form a local professional? Why?

How promptly will a edge foreclose on you?
Question:
How delinquent do you have to be contained by your payments before your sandbank forecloses on you? Three months? More? How long do you have?
Answer:
Depends on which state you live within, and how long you have have the mortgage. Most states will not allow foreclosure to begin for 6 months, if you are delinquent on a mortgage for which you enjoy had for more than 2 years.
Check near your state attorney general's office.
Well if you haven't made your payments for three months they will start the foreclosure process, although that take 1-2 months to get done. I know someone in that position.
Foreclosure proceedings usually start at the 3 month inscribe. The mortgage goes to the defaulting department at that point. You can call the specialist and ask for a work out agreement, but be prepared for a deposit and once it go to that department then it is contained by the hands of a subcontracted attorney and presently you have a ton of fees lying on the delinquencies. They will not balloon it on the back, it will be spread out over 9 months and you can negotiate it over 24. The percentage vary. The souk is in such turmoil that the lender does not want the house backbone so they are bending over backwards to help the consumer. Don't verbs this with power, the rules that be always within place apply. If you get into a work out agreement do not founder your end.
The foreclosure is swift and to the point. the audible range is it, and if they win you are out. They will evict your stuff. The myth is it takes another year to collect the property, and to be precise simply false.
Hope this works for you. Good Luck!

Can landlady put rent up if property surrounded by want of repair?
Question:
Answer:
Yes, the landlady can raise the rent at any time, if it's not prohibited by lease. If you're unsatisfied with the condition of the property you can attempt to chat her down, but she has the right to set her prices, and you own the right to move if you don't like what you're getting.
Yes. Whether she can rent it at that price is a different issue. If you are still contained by a contract, and she has given you proper become aware of that rent is going up, she can raise it.
yup. buy something if you do not resembling it.
It depends..
If the repairs needed are bad adequate that it is unsafe to live at the location then no. But, you hold to request in writing that the work be done, and remember to transport that request in certified correspondence. If it is not about a repair that you want done at the property, and the landlady is holding rent as payment for prejudice done.. Then yes they can do that.
If property is not in livable condition, afterwards I would start to look for other places to live at.
If the damage is claimed to own been done by you, and she is holding rent to money for that damage, after you can get that put money on only if your contract doesn't stipulate that she can hold rent or deposits for hurt to the property. If it is verbal after the contract would most likely failure to pay to the standard lease laws surrounded by your area.
Sorry.. Just not sure what you are asking here for sure.. If you could clarify, I would be glad to grant more help.
How complicated to win mortgage-loan ? And......?
Question:
How hard to grasp load for @100,000 (real estate) and I am on soc. sec. and enjoy bad credit. What should I look for??I plan to see it through and produce all the rite decision/payments etc.
Answer:
If you hold bad credit this will be difficult.
I am within this same position! I am trying to get a loan for a home, but no mortgage company will facilitate because I have discouraging credit. I can make ALL of the payments prompt too. What you can try to do is find a home that is "For Sale By Owner" and work it out beside them. That is what I'm doing. Or maybe try "Rent-to-Own". It's enormously hard when the credit's not biddable..(I'm in indistinguishable boat)
You may want to take some time to repair your credit until that time you get going. If you do pick up a loan, the terms may be cost prohibitive. It depends how unpromising your credit actually is.
Hi, I'm not sure what state you are surrounded by, but i'm a mortgage broker in Texas, and would be capable of help you out. Please convey me an email to my yahoo address with your contact info, and we can discuss further! Don't verbs, there is hope! :-)
Tonya
Visit the below website to compare offer (without inquiries on your credit report)
Okay, let's do a reality check: You promise you'll spawn all the payments, but your credit and credit win tell the story of the second several times you made that promise. You see, your bad credit tell the world that you don't follow through on that promise. "I plan to see it through" are just words, and you hold proven that you don't stand up to your word. And, by the way, applying for any loan imply you plan to see it through. If you incurred debt previously without intending to "see it through" afterwards you basically stole money. Don't bother buying a house. The governing body will be giving you room and board for the next seven to ten years. So you see, everyone know that when you make a promise to repay, you're merely saying what you imagine they want to hear in instruct to get the money you want presently. You're not making a promise. You're scamming for money.
When the lender underwrites the loan, the lender examines how credible the borrower is to follow through on the promise. How can you make family believe that you will do as you promise? You can start by making good on your already existing debt. You see, when you shop for a mortgage but you still owe lots of other individuals money, that tells the lender that what you want presently is important, not what you promised previously. So the lender know that the minute you set your sights on something else, its debt will become unimportant to you. Your words cannot prove to populace that you will change, to some extent, you must show people that you hold changed. Get your financial house in demand, then you will be within a position to buy a real house.
Go to financial counseling. Write down a budget. Call the folks you owe and ask them for help. The answer can be found contained by taking care of the debt you currently hold and then planning to purchase a home, not contained by piling on more debt.
