Ask for a copy of ur rental agreement. If they can't present u a copy, pay 1 month rent, and move off the place spotless, and in great condition.

If they bear u to small claims court, and don't have a copy of the rental agreement later, you won't be liable for anything. If they DO show up with a copy of it, later u'll be responsible for whatever u agreed to contained by the rental agreement.

I need to catch rid of a problematic tennant, the only problem is i don't hold a permit to hold the apartment below my single family home. How can I carry rid of her.?

she will more than likely be granted 30 days to walk out, whether there's a permit or not (in my state, if someone sleeps over at your house for 3 days or more, they can technically claim they live at hand.) so tell her to walk off, call the police and they'll say-so she can stay a few weeks. but at least it will be documented if she doesn't be off within the official time allowed.

also, you can be legally a pest to her. stomp on the floors, be loud..anything to sort her WANT to leave.

Well... essentially, ur saying u enjoy someone living in an apartment, below your home, which is not allowed beneath the housing laws of ur nouns. and u want to remove her. but u probably don't have a rental agreement, since that would be evidence against your prohibited renting of the unit, and u can't evict her, cuz legitimately, she's not your tenant, rather a house guest who pays you for your munificence.

I would just speak about the "person" you don't want them there anymore, and that they can stay for 3 months, rent free, to collect up for a deposit/move-in for a new place.

Give them a 30 day awareness to leave. If they don't, start eviction proceeding within your local small claims court. Small claims courts do not deal beside illegal apartments (that's departed to housing court) so it should not effect your housing status. If worse comes to worse...turn your apartment in to the housing department...you'll carry a warning and they will hold to be out within 3 to 5 days.
