Can a Ca. lease innkeeper keep hold of my deposit if I never moved contained by because of unsanitary conditions of the property?

Question:
I signed a lease agreement and gave a deposit on a residential property within the state of Ca.

At the time of the signing the place was a mess, but be promised that it would be clean by the 1st of July. As of today the 6th, the place is still a mess. The showers own scum and mildew, toilets are dirty, the microwave have what looks like an exploded pizza inside. Also the innkeeper hasn't removed furniture that still remains in the house and garage from the previous tenant.

He insists that he can justifiably keep my deposit? I told him since the house wasn't available to move into, that he broke the lease. In any satchel there must be some style of out due to the unsanitary conditions of the home. HELP!

Answers:
Sue him in small claims court for breach of contract.
Not sure roughly Cal., but you may be entitlted to triple damages.
Was the promise in writing? That would assist.

First, I would document what happened. If you can take photos of the place that would help. In that luggage you could send copies of the photos to the proprietor, and tell him, "when the find sees these photos, do you presume he will agree with me or next to you?"

Then if he doesn't relent, take him to small claims.
I dont believe he can legitimately keep your deposit. I have a similiar problem but it was within NY and i told the landlord that i will whip him to small claims court and actually call to put my name on the enumerate in baggage he didnt return my money. He gave me put money on most of my money but kept half of one of my checks,,,,i didnt bother taking him to court for that.

angelic luck.
Well the complexities of the landlord tenant perform in California prohibits me even trying to report you what I think. Best of luck on your research
This is an issue (unfortunately) you'll probably have to budge to court for. Most deposits on rentals are non-refundable because the landlord can argue that he held the apt for you and did not show it to anyone else for this reason he has immediately lost a month of rent. But under your circumstances it seem that he should return the money.

Do you have access to the apt? Can you budge in to steal pictures of what you're claiming? If you answered yes then run contained by there and bring as many pictures as you can. Then distribute him a certified letter stating that you are requesting your money hindmost. Print out and include the pictures you took of the unit & attach it near the letter. Inform your manager that if you do not receive your money within 30 days that you'll whip him to small claims court. Hopefully this helps you out.

Good Luck!
It looks approaching a breach of contract since the place was not within move-in condition due to the personal property of another tenant or landlord. The dirtiness is not a reason to break the lease, but the personal items within the place and garage are.

Take him to small claims and sue for any damages you suffered (for example having your moving truck conferral your furniture to another location).

I am not a lawyer nor do I play one on TV. Consult one for legitimate advice.

EASEMENTS - This may be a bit "legal" however am only just interested surrounded by standard information.?

Question:
A public utility company is considering work on their and on my adjacent strip of property. They are requesting a lifetime easement for access however I am reluctant to consent to such. The work would be an esthetic modification to property but I would prefer to agree to access only for that time of year of time the work would be done. It essentially only effects me and not the community. Is near a specific name to an easement I might research that would one and only allow them such easement for a limited spell of time? Any advice in connection with pros and cons of lifetime easements? Any general info to be appreciated. Thank you, heinz

Answers:
An easement is an easement they can be for period of time or in perpetuity nought special about any. If you do not want to give them an easement within perpetuity then adjectives you need to do is endow with them permission to use the property during their construction.
You might want to look at this connection
Enforceability of Easements an article: http://www.lucs.org/news.cfm?id=219...
Best of luck to you
You need a advocate to protect your rights. Don't agree to anything or sign any paperwork until you see a lawyer. Contact your department of buildings or anything it's called within your town and get some info.
Retrieve your title policy to your property. Call hem or check or a website that may know how to help you become conscious what rights yo may be relinquishing
Nothing is free. You need to take an attorney, and advise the utility co. to stop the consideration. Once you allow access even temporarily you plain up a can of worms. They can then sue for lifetime easement rights on your property surrounded by order to protract the equipment. They have surrounded by house attorneys to handle these types of things, and adjectives of the $ to do it.
This is called a makeshift easement. They will pay you rent on utilizing the property. It will be a small amount because they are newly renting the land. If you grant them a permanent easement after they will have life span time access over the property. This can affect the market advantage of the property. I personally would newly sell it to them at open market value if the domain is not utilized for anything.
There easement rights are covered by federal law. You do not hold the right to limit them access to their property. You can whip them to court, but the law is on their side. They would also receive any damamges that the hindrance of the lawsuit caused.

What is the best path to rent an apartment within NYC?

Question:
I am about to move to NYC, what are the best ways to be in motion on about getting other on a one bedroom apartment. I am not looking to spend much because I dont have that much may be thinking in a $1000 a month. Any advice would minister to. Thanks

Answers:
It depends on what neighborhood you are in. There are some Brooklyn nouns apartments for 2500 for a tiny 1BR. Some areas are cheaper but they are not necessarily ideal. The tenant will request a credit check with 3 years remuneration history and two months security deposit.. It is frequently expected that your income is 40 times the rent. Do you enjoy any idea what neighborhood you are interested contained by? Is there anyone you can share a place near? Everything is expensive there. Food, utilities, parking and coup¨¦ insurance, taxis cabs, buses and trains, etc. Rents surrounded by NY can be legally raise up to 8% per year (not including rent control which is IMPOSSIBLE to get). You need to start looking on craigslist untried york to see what is being offered. Try to find a place effective public transportation.

Good luck and don't forget to purchase a renters insurance policy. Should be about $120/year.
HAHAHAHA A ONE BEDROOM FOR 1000, THATS A GOOD LAUGH, U COULD MAYBE LIVE IN BROOKLYN FOR THAT PRICE. MANHATTAN IS EXPENSIVE, I BEDROOMS ARE STARTING BETWEEN 2000-2500.

My brother have a child support lien on property that we both own can I still put up for sale?

Question:
My brother has a child support lien on property that we both own can I still market?
I had someone who contacted me who is interested surrounded by purchasing my property that I own 1/2 of along with my brother. I did a title turn out and discovered that their is a child support lien on the property. Can I still sell?

Answers:
The lien have to be satisfied. Dont agree to the face worth of the lien fool you. This could be for a LOT more than you think. Not to mention, your brother have to be in on the treaty as well. Depending upon the method you appear on title, you may or may not actually own 1/2 title. And you may not be capable of sell your partially. In point of fact, most populace would not buy 1/2 title to a home. You need to find your brother to satisfy that lien or it could conceivably munch through up all the equity back you know it.
Not without paying past its sell-by date the lien.
sure but you will have to recompense off the lien to gain clear title to the whole article which the buyer wants and near your brothers OK, if not will want a court order to provide
Any and all liens must be payed within order of date issued. Your first mortgage take precedence then any jr. liens (seconds, helocs) followed by judgement liens. In other words near is nothing you can do, it will enjoy to be paid, NO MATTER WHAT. However you can go it.
You cannot sell unless the lien is cleared by any you or your brother. (Or if the agency which placed the lien releases it, which is NOT going to happen.)

You have need of to discuss this with your brother. If he is surrounded by agreement with the Dutch auction, the lien can be cleared at closing, with a check from his proceeds going to the agency which placed the lien. A title firm can toy with this for you.

Just past calling an attorney in connection with wounding neighbor.?

Question:
I'm in a rental condo going on my 5th year. Close to work, shopping etc. Have contacted out of state owner of condo downstairs on the subject of his tenant who plays loud sub woofer asked him to have the guy stop. Tenant does not stop, immediately find out tenant was involved within a dwi, hit and run damage to property, no operator license. The tenant/squatter is there by evasion. The tenant was living in attendance with his girlfriend until she died surrounded by May. The owner her dad has allowed this guy to stay near because he said "guy was so virtuous to my daughter".
Thing is tenant is destroying the place, and the car involved surrounded by the hit and run is the dad's. The condo association has sent the dad a notification, but still the owner has no intention of kicking the guy out. I don't want to run to the outrageous expense to move. Not even sure if an attorney can help me probably not.
My lease entitles me to tranquillity enjoyment of the premises, but that I can use to break the lease which puts me contained by the move position. Any Ideas??

Answers:
If the condo association has already gotten involved, budge to them and have them increase the pressure on this guy. They hold more sway in these matter than you will.
Sue! That will get their attention. Also, punitive as capably. They are in despoliation of their own contract. You have a slam-dunk travel case as far as I can tell. But, I own only hear your side of the story.
Contact your attorney.

Depending on the state and local laws, you may be capable of sue or press charges against the homeowner, for not taking action.

Make sure you inform the homeowner within writing on all problems and hold copies.

The DUI and driving issues are criminal and are for the police.

Call the police for the excessive noise. Every time.
Think of it contained by a different light. By that I niggardly, Would you like someone who have information on a hit in run that involved your domestic member to name it in? Basically, Your thoughts should be to comfort the unsuspected victim of the hit within run. Call it in to the police so that it can be taken supervision of. With the other problems, check with your city in the order of a noise ordnance or a bane of your existence law. If at hand is one, you have every officially recognized right to call the police on the tenant below. Keep recaords of adjectives of this for you landlord. Call him again and tolerate him know the problems again. Keep it written down. Then you can also get ahold of the housing authority and kind a complaint to them on the inability of your landlaord to solve the problem. You do have the right, you purely have to move about about it the long path. But, it will be better for you in the long run. You shouldn't enjoy to be forced out of your house, but if you are, this will again protect you if you do need to break you lease. Good Luck.
Invite the guy up for coffee. bring friendly. He must be very lonely -considering adjectives that has happen. Casually mention that you need greatly of peace and quiet because of a stressful errand and cannot figure out where on earth all the swish is coming from- can he help?
I would bring back the owner of the condo you are renting involved. It is the owner who is burdened to enforce the lease and respond to the association by laws of the complex. The owner risks losing obedient tenants. You should not be obligated to solve this issue. Call the owner, put the issue contained by their hands, and document any further complaints contained by the event you choose to break the lease.
Your first steps would be documentation.

Is the music being played loud ample to warrant a "public nuisance"? If yes, call the cops respectively and every time he cranks it up. If they issue tickets, then you would hold a case contained by court if the owner refuses to boot the guy out.

Without material proof it would just be a "he say, she says" lawsuit and the only ethnic group that win those are the lawyers.

Good luck!
u dont stipulation a lawyer, what you necessitate is 911 on speed dial. everytime he is playing the subwoofer CALL THE POLICE> they will fine him for noise ordinance. Maybe ask some other tenants if they agree this personage is a problem then you could adjectives speak to the owner and express ur concerns. Have a heart the guy just lost his gf not even 3 months ago. I am sure he is going through deeply of trama and saddness. I think if you possibly speak to him and let him know of your concerns he might be capable of fix his actions and be paid everyone happy. hold a heart this guys is going through a lot. the end thing he wants is to be out on his a** homeless.

I am a 22 year old disabled masculine. I get $600 a month from SSA. I have need of to know how to get on unit 8. I filled out an application a year ago and still not a soul has contacted me. I am currently living within a friends basement.

Follow up on your innovative application. Update information if you need to.

Many areas own waiting lists of up to 3 years. First come, first serve.
Getting a Housing Choice Voucher (Section 8) can be a looong keep on.
You should contact your local housing authority and see where you might be on the waiting roll. Or you can apply in another jurisdiction if their waiting catalogue is shorter. However, the community's residents are given preference over non-residents.

If you can't dally, you have other option. There are apartment complexes/public housing that can approve you on-site, without a voucher.

Also, once you find your Housing Choice Voucher, you can use it to help pay cheque for your mortgage on a new home. If your housing authority participate, you could qualify for the Homeownership Voucher Program.

My house apraised at 369K, my permitted proposition be 345K.. can I borrow 355K and attain bread at closing?

Question:
My credit union allows Maximum loan-to-value of 101.50%-- does this propose as long as my amount borrowe doesnt go over 101.5% of 369K sick be OK

Answers:
It is possible, but it depends on the policies of the lender. many lenders enjoy policies that they will only fund the lower of the purchase price or appraised appeal, no matter what the appraised attraction is. the reason for this are that lots lenders have be burned when they did a larger loan due to an inflated appraisal, then next found the house wasn;t worth it when they later have to foreclose. This was a huge problem surrounded by the 70s and 80s, and it still occasionally happens presently.

So if the lender says okay, later sure. If the lender says no, you could shop around to find one that will do this.

Another substitute is simply to purchase it now at $345k, consequently in 6 months refinance.
Yes you can. I would think twice though because typically you get a high interest rate when your loan to value exceeds 80%.
