In commercial existing estate, what does the occupancy "due diligence" refer to?

Question:

Answers:
The following does not constitute legal direction and you are strongly recommended to seek the suggestion of an attorney in your community.

Generally "due diligence" refers to the investigation you will want to brand name before purchasing any genuine estate. There are many companies who for a tax will perform due diligence investigations on your behalf. These investigations include but are not controlled to checking on zoning, permits, any citations for safekeeping problems with a building, performing an inspection of the property to identify potential risks including upcoming costly repairs which you may obverse with the purchase of the property.

In most cases you will trademark an offer to purchase a property. If the donate is accepted you will be given a short spell of time to perform your due diligence investigation as identified above.

How do I collect money from a former renter?

Question:This is in Florida. I own a roommate getting ready to move out (voluntarily) subsequent month because she can't pay rent. She still owes me money from second month. I never had a rental agreement signed. How can I build sure I get my money stern after she leaves. I know she will be around for 6 months (stuck in Coast Guard here). Do I enjoy to take her to court and will they be capable of garnish her wages? Is at hand anything I need/should have her sign? Is here any other LEGAL way to go and get my money back?

How can I supply my father's Colorado mountain home for him FSBO from Missouri?

Question:

Answers:
Assuming that your trying to assist your father by helping him place ads and your not attempting to be an unlicensed agent...

1) Is your father going to be home to show the property to potential buyers?

2) Is your father likely to pay a commission to the BUYERS agent? If not this is going to be REAL difficult;

3) Does your father own a real estate attorney or someone available who knows and understand all of the disclosure law which are required to be followed when selling?

4) Will your father be willing to drop doesn`t matter what he is doing at almost any hour to be home to show the property to a perspective buyer? Does he have a mode to pre-qualify potential buyers so that his time is not wasted?

If adjectives of these are yes then:

1) Go buy a sign and place within front yard near a phone number that will be answered,

2) Go into town and pick up a few real estate mag's. Take some devout photos of the house and list the home within the mag;

3) Visit some of the local agents and let them know that the property is FSBO but he will is prepared to pay a BUYERS agent a commission. If he is unwilling afterwards your basically hoping that some passer by see the sign and wants to buy the arrive. Don't think for a second that the local agents will not know his property is on the souk and if he not willing to salary them if they bring him a buyer. If that is the luggage then I will bet no agents will accidentely drive down his street near a client in the saloon so that the agents client can see the house and go; hey what nearly that one!

4) Inquire with a couple of agents if they will record the property on MLS for a small fee. This course the property is exposed to more people.

Basically, I would find an agent, negotiate a allowance and have the agent do adjectives of the work. If your father is unable or unwilling to be at home, show the property, adopt calls whenever they come contained by then best of luck to ya.

real estate agent You could, technically, but I wouldn't insist on it. You need a trusted character there locally to show it. Right? Find an EXPERIENCED agent for this chore. That way, you will know you are contained by good hand. Call some local brokers there, and ask for their best selling agents. Then interview respectively one by phone and choose from 3 or 4 you like.

don't be cheap, use a realtor!

unless you have a LOT of time and money to lay it on thick the home, conduct open houses, etc, as in good health as A GREAT AMOUNT OF LEGAL KNOWLEDGE i do not suggest doing a FSBO.

best of luck to you with anything decision you come to! You can't. Since you do not own the property it would be considered practicing genuine estate without a license.

Put an add within the local newspapers, more dear things you might try selling on EBay, or contact second hand shops that may help yourself to things on consignment.

ebay

1) Quickest/Easiest: Post flyers around your apt. building explaining when the mart is (today/tomorrow), the apt. number, and what's (generally) for sale. Then put price stickers on everything. This works powerfully for large buildings.

2) Easier: post ad/stuff on Craig's List. This might help yourself to a couple days, involves more work, and is best if you live in a big city. People will email you, and next you tell them how to go and get to your place. Ideally they come and cart the stuff away.

3) Sort-of assured: newspapers, courtyard sale, etc.

The bigger question is do you enjoy any money for a down payment? If you can fund a clothed sized down payment, plentiful mortgage companies will look over "okay" credit. Can you use a VA loan more than once to buy a house?

Question:If you used your VA loan to purchase your first home, can you use it again for a second home?

Answers:
The answer is yes, once you have compensated off the loan your VA licence will be restored... but you would only want to use it again(or even the first time contained by specific situations).

I'd recommend using a VA the first or more times if you really require 100% financing. If you do not, and can put down 5%, typically you will be better off not going the VA route.

The intention is because there is a funding allowance involved for use of your VA loan. It differs for the branch of service, but typically it's 2% for the 1st use, and 3% thereafter. (believe the Coast Guard is always 3%).

VA loans are deeply the same as Convential Loans next to Upfront MI(lump sum mortgage insurance paid at closing-just similar to a VA funding fee). At higher LTV's, VA loans are cheaper for a hold over 2 years... but when you are putting money down, it is usually much smaller number expensive to not go VA because of the upfront funding allowance.

Compare the figures, you might be surprised. If you are looking for a mortgage contained by FL, shoot me an email... I'll be happy to give support to.

Other Answers:
Do not use VA loan to purchase your first house

Yes as long as you reward off the Original document and with the 2nd home you must reside nearby. http://www.homeloans.va.gov/faqelig.htm
Q: I have already obtain one VA loan. Can I get another one?

Normally, if you enjoy paid bad your prior VA loan and disposed of the property, you can have your used eligibility restored for extramural use. Also, on a one-time only proof, you may have your eligibility restored if your prior VA loan have been remunerated in full but you still own the property. Best source for that answer is the VA

be in motion to the Va site and do some research on that subject..
plus with any luck they hold a contact button or a list of email address...
best of luck to you absolutely! You own to pay the previous one stale at the sale, but you can use VA over and over.

Best bearing to return with Mom to buy me a house?

Question:

Answers:
Have you ever thought of moving into Mother's lock, stock and barrel, as they utter? Always keep up the pretence of looking out for a better home but never think of it. The mon will be too relaxed to have you and the two grands beside her and be sure she will strike down whatever pretence of a proposal you would bring forth overruling father.

The solely snag is your hubby. A hubby is yet to be born(or should we voice yet to be married) who would tolerate the presence of mother-in-law within the house even in his worst nightmares.Do you know the standard quip? The tribal housewiife comes running to wake her sleeping spouce, " Come, rouse up, a tiger has seized mom!" " I pity the poor animal!" The husband says within a sleepy voice, turns on one side and resumes snoring.Take care of this front and sooner or following mom will give you a house

Or the husband will(most probably!)

You could return with a job, and afterwards you wouldnt need anybody to buy you a house. Stop anyone lazy.

quit being a mooch and earn satisfactory to buy your own Maybe you should be thinking about ways to buy things for yourself instead of getting mommy to buy them for you.

Grow up, get a errand, save your money and buy your own house.

Maybe you should RESPECT your mother and BUY HER A HOUSE as a THANK YOU for raise your butt!

put a gun to her principal :/ Play her in Monopoly.

Get a job and buy one yourself.

you could try brainwashing her but i doubt that you would do that as it would require you to move you idle so and so. i have another impression why not work and save to buy your own house as you will apprepriate it more as you did it by yourself. stop mortal a baby and grow up sweetie. be a man/woman and do it yourself.

hasnt the woman done enough ?? buy her a house !

Suggest that you assume responsibility for buying your own house.
Then, after you enjoy gotten a record of paying promptly for several years possibly your Mom will see that you are deserving of her help.

These answers are funny. When I read the question, I guess I more saw it as, "How can my Mom benefit from buying me a house?" because that's how you own to approach it.

You mother would get significant benefit by buying you a house for the tariff write-off and future appreciation from public sale. I don't know of a single parent (unless you're still in college full-time) who will merely give away the house short collecting some sort of rent.

Approach it with your mother as an investment. It would back if you had not easy numbers worked up. You can get these numbers by calling a local Realtor and describing them your plan. They would benefit if their numbers were obedient enough to convince your mother that it's a well brought-up investment!

how can i start a mobile home park little by little?

Question:i have really be thinking about this and know alot of empire who got into big time solid estate investing starting this way, but are not offering any guidance.it just seem simple.buy a peice of land, purchase a couple used trailers, rent them out for 100 a week, expand as you engender money.is it this easy or am i missing something?

Answers:
Well first you requirement to get it approved next to the city zones and adjectives that crap, second you will need to provide sewer and electrical hook up...

I would enunciate you would be better off to buy the lands, get it set up for sewer and electrical hook ups at respectively lot.

Then rent the lot...and let race move their own home onto it.... Maybe get $300 a month for the lot?

It could turn out to be a impossible deal for you if you rent them the home... If you carry some bad renters, they could verbs the darn thing, and in that you are with a pile of crap home which isn't worth anything, because of the fruitless renters....

Good Luck

Other Answers:
You may be missing some things here.

You need to provide sewage and sea and electricity. You also have to win zoning approval. I hate to mention this, but that usually requires funding for appropriate bribes for the zoning board and if there is deeply of public opposition, your bribes may be misspent money.

If you can not hook up to a municipal sewer system and water supply, you may be looking at considerable cost. You can no longer hold a giant septic system, I do not believe.

How can a soul next to an income 40k-50k and a wearing clothes credit budge roughly securing a home ?

Question:What is more appropriate in this casing: a house, condo or co-op ? Any recommendations on how to catch a low interest/low income loan?
Any affordable but livable places you can recommend in NYC or lower westchester county?

Answers:
You want at least to call on a local realtor and 5% down. However rates are much higher at 5% down. The best rates are at 20% down. There is a mortgage calculator at http://www.bankrate.com/brm/mortgage-calculator.asp

You can own around 34% of your gross income as mortgage debt.

Other Answers:
Contact a real estate agent within your areas he will be better equipped to answer your question

There are many ways to turn about it. First contact a loan rep, such as myself. But within are all sorts of programs available. First time home buyers programs, stated income/asset loans, an arm will provide a low clearing for 3/5/or 7 years. There is a lot that will determine what species of loan you will get other next credit and income. Do you have 2 years employment & residence history, your credit chalk up, and your debt to income ratio. If you split your loan into an 80/20 you can avoid paying Private Mortage Insurance. And when deciding on your property and it's payments consider the following: taxes, assesments, and if the property is within a flood zone (flood insurance is 3 times more expesive then newly having threat insurance.) Please contact me with any other question.

I don't know the demographics of the state, but from an financial standpoint, sometimes states that encourage population to come and live there might also be more affordable. Of course, there's more to consider than cultural make ups, approaching weather, terraine, a number of things. The Dakotas. Also no job, no entertainment, no stores. Lots of land.

Will you rent or lease to someone next to 2 med/small dogs?

Question:

Answers:
If you get a pet deposit and they won't disturb the neighbors...later why not?

Other Answers:
no do you know them are they good to pets no!!!!... if you do you do not deserve to enjoy them

first trust..afterwards go ahead Depends on the breed. A lot of insurance companies discourage renting to someone beside dogs due to the liability. It also depends on the quality of the character renting as well. If they're respectable, tidy, employed long term, etc., next I'd probably rent. I would though require an additional surety deposit to go towards any plunder the dogs might do.

Yes..
I would enjoy them sign some kind of waiver to protect against the furure potential for damages.. and elevate the security deposit properly.. however when the time comes that they move on.. they would achieve their security deposit rear legs in full as long as nearby was no twist done by the pups. I don't think pandemonium would be a factor unless it was an upstairs apartment next to hardwood floors.. typically, the smaller the dog, the smaller the bark :)
Good Luck

no. hell no. Ive been doing preservation for a landlord that have numerous rentals. Pets do conciderable amounts of damage to property. Not adjectives pet owners are responsible and of course everyone comes across as self the most responsible and cleanest pet owmer in the world untill they move out and the twist is done.
an accident on a brand new carpet, pet curls, pet odor, scratches on the doors, chewed walls, holes within the yard. poop within the yard. and the account goes on. ive cleaned and repaired rentals that have pets and the cost is hundreds and sometimes thousands of dollars. fixing drywall and replacing carpeting is not cheap!
Landlords are very reluctant to rent to pet owners (especially of cats) because of historic experiences. My experiences I would definatly not rent to a pet owner.

Will my Apartment ever currency my protection deposit?

Question:We recently moved from SC to VA. Our 1st months rent and payment deposit were written from our SC dune account. Our 1st monts rent check be cashed but the security dpt check have not been cashed on the other hand even though we handed them to the apartment head on the same morning. So far its been a two week difference since the 1st check be cashed. The SC bank charges us a monthly excise to simply have the picture open. We're waiting for the check to clear so we can close the sketch since we cant use it in VA. Do you have a sneaking suspicion that the appt complex is just holding the check until the wind up of our lease? The apartment manager have been so slow w/ getting stern to me...Thanks!

Answers:
They may have lost it, or it may enjoy been misfiled and misplaced and presently they cannot find it. If they tried to deposit it in six months the ridge migh refuse to adopt it as a stale check. The check should have be deposited immediately and compensated by your bank up to that time the landlord permitted lease. If it has be several months send a dispatch to the apartment manager stating that the reason on which the rent security information was drawn will be closed as of such and such a date, impart them at least a 30 daylight notice, and afterwards simply close the account. Include contained by the letter a statement that if the proprietor attempts to deposit the check after that that date then you will not be responsible for any hill fees they incur for a returned check. If there are any problems near them after that you can always endow with them a new check and you will own the letter to prove that you give them notice. You should not be expected to hold initiate a checking account forever for merely one check.

Other Answers:
buy him a money order mitt it to him.... stop payment on the check, close the details ... they wont cash the check after 6 months anyway
