My friend is going to move into my spare room and live near for free, does that breed her a lodger?

I am an owner-occupier of a flat and hold a spare room. My friend who is coming back to the UK to finish her final year contained by University wants to come and live beside me.

Thing is I want to let her stay for free since she's my friend. I want to know - by letting her stay beside me for free, does that make her a lodger?

My leasehold flat does enjoy a restrictive covenant saying I cannot hold a "lodger or a paying guest" so I am a bit concerned even by letting her stay for free makes her a lodger since I don't want to breach the covenant.

Secondly, if she does move within with me (and not rate me any rent), do i still have to notify the council? My friend will be a student anyway and exempt from council toll so I don't know if I have to consent to the council know or not.

I'm in truth revising land statute at the moment and trust me she will not be a lodger, she will just be a guest. As you are doing it for a benefit for a friend and she is not paying, you are merely giving her what is called a uncovered licence to be there.

Sounds like your lease say you can't have others live here. You'll be breaking the covenant.

Firstly, I am not at all sure that what you propose is a perfect idea- what if something goes wrong beside your little arrangement? How would you get her out if that happen?

Secondly, nothing within life is free! What roughly speaking bills and food- or do you propose to pick all these up, no concern how high they are?

Having someone to stay for a few days is one point, but for a year, consider how much this means contained by money terms! Can you afford for her to free-load stale you for that length of time?

Further, what if your friend offers provisional accommodation to someone she knows- say aloud a couple of nights, which next becomes a couple of months- what consequently?

It seems to me that what you're substantially considering, is a win-win situation for your friend, and an open-ended problem for you!
