What happen if I break my lease since I move contained by?? please relieve?

I found a house and signed a lease. I gave him a check for the deposit of the house. this happen 2 weeks ago. I have to move contained by on the June 14 but the problem is the house has not be finish painting ...runner still dirty...no clean backyard..cut grass etc and also he said he will enjoy a fenced backyard and this was one of the prime reasons why I arranged to rent it because I need the blockade for my children and dog... NOT OF THIS IS BEEN DONE AT ALL, I called him the other time when I sent my lease by fax to make sure he get it and he did not answer my call, I tolerate a message on his voicemail to call me posterior and let me know if he received my lease and NO RETURN CALL AT ALL
so at this point I don't know what to do/If I want to move within with this problems. he cashed my deposit check, I get the key for the house ..don't know what to do...CAN I BREAK THE LEASE AND GET MY DEPOSIT BACK??

Answers:   If it's not contained by writing, you can't prove it was ever agreed to. Either you move into the house and fix everything yourself, or you move somewhere else. I'm thinking you've completely lost your deposit, unless you jump to small claims court with your canceled check.
There's zilch that says a proprietor has to verbs the place up before you move within - unless they put it in writing. My parents other had to verbs places up when we moved in, and we lived surrounded by several different rental houses when I was a kid.

You can other break the lease but getting your money back is another item. Is any of this in writing? As the adage goes within real estate "a choral contract is worth the paper it is written on". I am afraid you are stuck if you don't enjoy it in writing.
