Can you patent something that was copyrighted in a book? keep in mind this new invention is not being made.?
Answers: Do mean something like James Blish's "spindizzy"? Sure, make one and patent the thing. It just might make you rich and famous.
What's patentable is the "Process" Copyright is the written word, not the process. Consider software. Though copyrightable, the lines of code are not patentable, but result of what those lines do is potentially something that can be patented. I copyrighted the rules to a game that I invented. The idea is not protected, only the words I wrote. Ideas cannot be patented, only the process. A big pharma patents a drug that fights aids. The IDEA of fighting aids is not patentable, but the process of what the drug does to the aids virus is

I think more details are needed. If the book details the design and operation of the invention, then the idea is not patentable because it has already been released publicly. If the book merely describes an invention in terms of what it does but not how it does it, then the "how it does it" is patentable.
Edit - From what you described your "invention" wouldn't be patentable. It isn't new, somebody else told you how to make it.
One of the requisites for a patent is that it be novel. You could file for a patent and be awarded a patent, but there would be a strong and honest reason to nullify the patent based on the fact that it was not novel. The way around that is to pay or otherwise get the originator to sign a quitclaim, and then you would be in the clear. The other factor is that the majority of patents are applied for and awarded in order to bloat the cv or ego of the applicant and have no hope of paying off. In that case defending a patent is moot from a practical standpoint. Another approach is the design patent. The requirements revolve around whether a design is recognizable and identifiable in such a way that a proprietary interest could reasonably be depended on to be a reliable investment. The design for the Muppets were stolen simply by someone registering earlier than the actual originator. The McDonald's characters like Ronald and Hamburglar were lifted from a TV show, and the producers of the TV show were awarded undisclosed millions for McDonalds to continue to use them. In that sense a design patent is like a trademark.

Can you relate me why this product is not selling?
This is NOT a solicitation to buy. I would like ONLY feedback about my ebay posting and your opinion as to why it is not selling. Thanks!h t t p ://cgi.ebay.com/ws/eBayISAPI.dll?ViewIte...
Answers: I go to this site and I think one problem might be that it is sort of confusing. The photo doesn't suit what you are marketing. I also think in that are too many words. I would suggest you "clean" it up, be somewhat more clear and especially, a little more direct. eg. account a problem - offer the solution surrounded by point form.
I think the product sounds great but again, I found the full post a little confusing.
If you click onto your relation in Ebay, that will supply us the exact details to get to see what the problem is. Otherwise you wont receive any sensible answers as we cannot find your item. Failing that, give us your item no. we can see it that passageway.
