Trademark at state stratum?
Trademark can be registered at both the federal and state level. If I registered next to federal, why would I want to register with the state?Answers: You want to start by registering your trademark at the state horizontal so you weed out your impossibilities first. For example: If the trademark "Classic Construction" exists surrounded by California but not your home state of Nebraska, why would you want to go to the federal rank first and waste your money. In other words, it is easier for them to do a check surrounded by your state first than all over the country. I do see your point though because if a lasting trademark has be taken ANYWHERE in the country, you can not register it for your own.

If the name have not been trademarked, a company can incorporate and use a business christen that is used by a business surrounded by another state. But they cannot use the same heading in alike state. Thus there are instances when one business contained by one state has like peas in a pod name as another business contained by another state
Two companies CAN have alike name if 1. they're not surrounded by the same state, 2. if the given name is not trademarked (like Nike, Disney, Coca Cola, etc.) and 3. if the businesses are two different things (like a florist shop for one and a retail gift shop as the other).
They can't own the same moniker if both businesses are in duplicate state.
