Paid pay brand name smaller quantity than minimum wage...allowed?

I work for a small business and I am on salary.I am given a once a year salary and they slip it up between 26 pay envelope periods and that is to say what I get every two weeks...if I bring my gross amout and divide it by the 80 hours I work in that payperiod it comes out to a bit under $8 an hour.and as of Jan 1st that mode I'm making under minimum wage...my interview is...is that legal or does minimum wage individual apply to people who get hold of paid hourly.


Answers: Minimum wage have nothing to do beside salary force. I worked in a appointment center for over 3 1/2 years and when I divided my hours into how much I made I was one paid smaller amount than minimum wage. Salary jobs are singular great when you work really close to 40 hours a week. This is one of the main reason I went into business for myself and find to work from home. You should not be asking this question, because you hold no reason to be working for smaller quantity than minimum wage.

Ask yourself why you would want to work for a company which disregards the needs of its personnel - and then start asking other companies if they're hiring.

Update: Don't throw away your time arguing your worth with the society who are exploiting you.

You cannot rely on anyone else to tell you what your time is worth - similar to many things within life, you must look out for your own requests (despite what others may tell you).

Find a charge that pays you in strip with your skills and contributions - constraint the pay you deserve and do not settle for anything smaller quantity.
It may depend on the state you live in but, I believe they still hold to pay you at most minuscule minimum wage because that is a federally mandate law.

Call your labor department and interview them about it.

Also, depending on your state, it may be forbidden to pay you remuneration unless you have the authority to hire & fire. (I twig that that is the canon in NJ, where on earth I used to live.)

Please call the labor department so you know what the canon is before doing anything.
You may or may not be right within what you say--I take it you live any in California or Illinois where on earth the state requirement is higher than the federal requirement of $5.85/hr.

"Who Must Pay the Minimum Wage?
The minimum wage canon (the FLSA) applies to employees of enterprise that do at least $500,000 contained by business a year. Workers Who Earn Tips
Employers who allow workers to keep tips must remuneration a cash minimum wage of at least possible $2.13 per hour IF they claim a "tip credit" against their federal minimum wage obligation of $5.85 per hour. Overtime Pay

Under the Fair Labor Standards Act of 1938 (FLSA), executive, administrative, professional, and outside sale employees are exempted from the minimum wage and overtime requirements of the FLSA, provided they come together certain test regarding available job duties and responsibilities and are compensated "on a salary cause."

By imperative, states are allowed to establish their own minimum wages and regulations. However, anytime the state minimum wage differs from the federal minimum wage, the higher rate applies.

I wonder also if you took your full year's salary and divided by 26 earnings periods of 80 hours a week because as you noted, you enjoy vacation. I suspect if you own 2 weeks vacation and didn't verbs that out that if you do recalculate you'd be over $8/hr. If so, I don't think that qualify as being below the rate, though you can contact them and ask.

Answers: There isn't one, just a limit to hours based on her age.

A child can always work in their parents business.

At least in the US, maybe not elsewhere.
When I worked at McDonald's the owners son worked there also and he was 14. He was not allowed to cook or go near the deep fryers.

If You Are 14 or 15

When your attendance at school is not required, you may work in stores,offices, and other places, except in a factory workroom. You may do delivery or clerical work in an enclosed office of a factory, and in dry cleaning stores, shoe repair shops, and similar service stores.

With a family owned business, I think she would only have to be in her teens.
If she wanted to work somewhere else, she would have to be at least 16.
I do believe if she is in school she can start at 16 as an employee with a work permit. Since this is your family owned business she may be able to do small jobs for allowance or something but I don't think she can log hours.
Laws regarding employment by minors vary by state. It's not just the minimum age. Laws also cover how many hours a week that minors can work. Contrary to what some others have answered, family-owned businesses are not "exempt".

Just contact your state's Labor Department and ask them.
