Small Business Questions and Answers

Need suggestion concerning business partnership.?

I am in a 50/50 partnership near a good friend within a small business. When we started out his wife did the clerical work, bookkeeping, and phone answering for us and also attending some events here and there newly to help out her husband surrounded by his new business.

Now it is a year after that, and my partner suddenly wants his wife cut within on 30% of the business profits for her help, prety much making her a 3rd partner. This would go me with 35% of small profits we own been making so far.

Granted, she does do seriously for us, but I was never underneath the impression we would be paying her anything, especially such a substantial sum. I would not hold accepted her aid had I certain. 30% of business profits for emailing/phones/paperwork seems agency too much.

My partner is a good friend and I am not sure what I should enunciate or what a good solution would be to this problem. Any suggestions or warning is greatly appreciated!

Answers: It is not easy contained by these situations.

In retrospect you should have put a partnership agreement within place that outlined the roles of each partner and how the profits would be distributed.

Now you'll hold to figure this adjectives out and it isn't going to be easy. I ask you, negotiate a settlement and an agreement for future duties and profits and put contained by on paper within a formal partnership agreement.

Perhaps you can negotiate a cash settlement next to your partner for his wife without giving her any claims to adjectives profits. Set an hourly dollar value on her services for adjectives work and pay her as expected.
My opinion nearly partners and their spouses is this: simply you are getting two for the price of one. It's not only considerable to keep your partner optimistic, but the spouse too.
If she/he is willing to do a proportionate share of the work, that could be a positive.
I would prefer outsourcing the accounting to avoid a conflict of interest, especially if your compensation is base on profit- that could be a Grey area specifically too tempting.
I'd suggest getting some quotes on how much the work could be done for, and craft some comparisons with your partner, showing him how you would be paying more for a latest partner as opposed to an hand.
Should you end up beside some disagreement, ask your partner for a price for him to sell the business to you. This number will ALWAYS be complex than the number he would offer to you. After man presented with that, ask him to buy you out for that price.
Good luck!

What would you do as a administrator if one of your customers complained of human being charged twice?

Assume that you are a bank official. One of your customers was charged twice for her mortgage clearance because of an employee error. How could you write a notification of apology to the customer and a memo to your staff on change to be made to avoid such errors?

Answers: You tell the customer that you appreciate the error individual brought to your attention and you have corrected the problem and the procedure. You apologize for the error. Clearly if any fees of any sort be incurred by the customer (such as overdraft, etc.) those are reversed and a letter of explanation sent to the companies involved on strict letterhead taking full responsibility for the error. Furthermore as all bank have some PR/advertising funds available (such as incentives to unequivocal an account etc.) the smart superior would send what he admit is a token for the inconvenience such as $50.

Memo would not blame anyone for anything but explain that a customer brought a problem to the management's attention and a mortgage was processed twice. This is how we prevent that from ever occuring again and outline the procedure. If you enjoy any questions, contact x at y.

I in recent times set up my LLC myself. Do I entail to apply for an EIN?

My company is a one person multimedia company. Do I still want an EIN?

Answers: If you are a single member LLC and own no employees the IRS does not require you to enjoy a EIN. You will need to use your social shelter number as your tax self number.

Some people prefer not to use their SS number so the walk ahead and request the EIN by filing a SS-4 form or by going to the IRS website www.irs.gov It doesn't cost anything to procure the EIN so it is up to you.
All of your questions can be answered here. If you find out that you do requirement an EIN, you can apply and receive your EIN the same time.
