No possible way to say. The "rebate" has NOT been passed by Congress yet. They are fighting over the language and other parts of the bill such as business tax cuts, increases in unemployment compensation, etc. Don't expect anything until sometime next week or even later.

But you need to take care of that I went to court with someone when they got a speeding ticket once and the person the judge saw before him was someone being charged for not filing and he was taken to jail that day.

Generally no. Unless in that is a court order that meet VERY specific guidelines as laid out in Federal directive the custodial parent gets the exemption. Many decree do NOT contain the necessary talking and if it does not conform with Federal canon the IRS is required by law to rebuff it.
The custodial parent can relinquish the exemption to the other parent by giving them a completed Form 8332 or similar signed written statement. The non-custodial parent then attaches the form or statement to their rates return.

Contrary to what several others have posted, the amount of support that you provide is NOT a factor within claiming a child on your tax return. The ONLY support testing that has to be met is that the child did not provide more than partially of their OWN support. There are plenty of parents claiming exemptions for their children who have rewarded little towards the child's support. The law have been that mode for several years now.
No...when you wallet you have to state that the child LIVES next to you, paying support isn't good satisfactory.
