My girlfriend and her son, who is not mine, have be living me for the past 3 years. A co-worker have put a bug in my ear, and say that I should be able to claim go before of household. I pay adjectives the rent, utilities, insurance, car payments, and other uncharacteristic and end bills.

She works and claims her son on her taxes, but lacking my income she wouldn't be able to support herself and the little human. HA!

Answers: No, your co-worker is wrong.

The child must go by the "relationship" test for you to qualify.

Relationship — the taxpayer’s child or stepchild (whether by blood or adoption), foster child, sibling or stepsibling, or a nouns of one of these.

Your girlfriend's child is not related to you.
The child does not qualify you as hoh because he not your qualifying child or qualify relative

Your girlfriend could claim hoh if she paid more than partly of the cost of keeping up the home

If your girlfriend did not work you could claim her and her child as a dependent but not for EIC credit nor would you be hoh.

Your girlfriend should be filing Head of Household beside a dependent child. She should be getting at least 1,500. I did when I worked piece time and had my son.
You cannot file Head of Household. As long as she states she pays 50 % of ulities and expenses for her child and the home she lives in she is entitled to those rates breaks. She can still retreive back taxes if she feel it's owed to her as Head of Household with a dependent child. Of course, I haven't file my dependent taxes since 2003 so I don't know if the tax rules own changed. This is why they mail those rates booklets. Always read those booklets even if they seem boring. To adjectives tax question always read those import tax booklets that have your charge forms inside of them.

If she made more than $3400, you isn't anyone's dependent her son is her qualifying child. Since he's her QC, NO one else can claim the child as a qualify relative.

If she lived with you adjectives year, made less than $3400 and you can show you provided more than partially of her support, then she's YOUR qualify relative and as a dependent, she can't have any. Bingo, the child is up for grab under the SAME qualify relative rules.

Then you STILL file as single, but attain to claim $6800 in extra exemptions. As a QR, you catch that, but not HOH, not EIC, not child care and not child charge credit. You need a Qualifying Child for that and this kid isn't related to you by blood or marriage ceremony.
