What should I do if I rewarded taxes on disability insurance and it should enjoy be worker's compensation.?

My company paid 100% of the premium for short-term and long-term disability insurance. In 2006, I be sent a W-2 to report this income, since it is taxable. However, later that year the injury be accepted as a worker's compensation claim, which is nontaxable income. I thought I'd find an amended W-2 from the insurance company, but I did not. Should I file an amended 2006 toll return or is there a route to report this on my 2007 tax return?

Answers: No, the income is taxable because the source of the money be the disability insurance which was not salaried with after due dollars on your part. Had it be disability insurance that you paid for near after tax dollars, after it would be tax free.

The workers comp item is a side issue. Any money you got from a workers comp claim might be levy free, but this money did not come from a workers comp claim. In most cases the same insurance company does not bar both lines for an employer. The workers comp carrier be probably not the same as the disability delivery service.

If they subrogate and win, yes "Just Me" is correct. A 1040X may be required to fix the issue.
Did the carrier of the disabaility insurance company subrogate against the worker's comp possessor to receive their money back? If they did, you may know how to appeal to the IRS that the money was within fact salaried by the worker's comp carrier. I am really not sure but it won't hurt to ask the IRS
