Child born outside US during 2007 and brought into US within 2008- Can I claim supposition and apply ITIN?

My child is born in 2007 contained by India brought to US in Feb 2008. My visa type doesn't allow my child to attain SSN. I am living and filing taxes contained by US for last 6 years.

Can I apply for ITIN for my child and also claim conjecture.
