Am I obligated to folder my taxes as one near my wife?

I know that I can file "married but file separate", but I think I file jointly ending year. Will it be a problem if I filed separate this year?

Please assist...


Answers: you can do that - but, if you have children- you lose out on child rates credit etc.. that you would get if you file married filing together-
it wont concern. as long as you file as married

but if one of you database an itemized list afterwards you both have to database that way
no, in that won't be a problem but you may miss out on some tax benefits that you would draw from filing mutually. Such as the EIC if you qualify for it.

Tax Advice - Claiming dependents?

My wife and I seperated in June of 2007. We are within divorce proceedings but it's not final yet. We own 2 children, one son together and a daughter who is hers from a previous relationship. I'm not able to formally adopt the daughter, but I've be her legal guardian for 8 years. Since June of 2007 the kids hold lived with me and I've be the sole provider. However, in belatedly December they moved in next to her.

Even though I was the primary provider for the kids, I want her to know how to claim them for 2007. How can I do this? Is there something I requirement to sign?


Answers: Actually, it's form 8332.

It gives the wife the right to claim the $3400 exemption and the child charge credit only. She can't claim qualify child since SHE didn't have them for more than 6 months.

As custodial parent (which you are), you hang on to HOH eligibility, the child care credit and EIC.
I suppose they will base how much time he lived beside you. I don't think you can allow her to claim him only cuz that's what you want.

Call a local tax advisor and see what they influence.

Answers: If you get the rapid refund they take it out. Otherwise you have to pay them up front when they do your taxes.
I work for H&R Block. If you want your fees taken out it will cost you $30 plus the tax preparation cost. If you want your refund in two days the loan interest cost is about 1% of your refund.
