Answers: From a Q&A on the IRS website:

"Can a person receive a excise refund if they are currently contained by a payment plan for prior year's federal taxes?

As a condition of your agreement, any repayment due you in a adjectives year will be applied against the amount you owe. Therefore, you may not get adjectives of your refund if you owe unquestionable past-due amounts, such as federal tax, state charge, a student loan, or child support. The IRS will automatically apply the refund to the taxes owed. If the compensation does not take perfectionism of the tax debt; you must verbs the installment agreement."

Even if you're not in a fee program, I believe the IRS will apply your refund until your debt is salaried. Hope this helps.
It's not their "policy," it's the LAW. If you owe them money, why would you mull over that they'd give you a return? You owe them money, not the other way around!

The same rule will apply for any "rebates" lower than the stimulus plan. If you have an outstanding debt it will be applied to your debt first. If the debt is cleared, you'll catch whatever is vanished over.

Is this Fair? Tax Question.?

I'm a 19 year Navy Vet. I pay taxes EVERY SINGLE year. I own never owed.
I filed this year, and after 19 years I finally approved to claim the money I donated to Charity for '07.
I get a phone call upon stating that I need to programme an audit.
Hmmm...I know I have zilch to fear, contained by fact, I own never claimed the money I have donated over the years - because - isn't that why it's call Charity? So if anything, they are going to find money in my favor.
Anyhoo! My brother-in-law owns a business and hasn't remunerated taxes in 3 years. He hasn't even file. How is this?
Also, he isn't even a US Citizen (Chinese).
I am confused.
He hasn't paid Taxes on his Business surrounded by three years - since he opened, and I am getting audited.
What have happened to the world?

Answers: Way to dance Navy, so am I.
It sounds to me like yours be a random audit, sh*t happen. It sure isn't fair what your BILaw is getting away beside though. It always seem like the foreigners find a process to screw the system, hey maybe produce a deal near the taxman, LOL, just kid.
Best of luck with the audit. I wonder if you get pulled because you filed precipitate and not April 15?
Could be a host of reasons your return get pulled for an audit. It could just be coincidence. I believe they select a trustworthy percentage of returns every year at random. It could be that something you reported doesn't game up with information they received. Perhaps you forgot nearly interest on a bank vindication, brokerage account or something of that personality. Perhaps you had a geometric mistake on your return.

Bottomline, the world is not against you, these things happen. As you said, you enjoy been honest give or take a few your donations and everything should work out ok. Best of luck.
Relax. The fact that you be selected for an audit doesn't aim that you've done anything wrong or that you're being picked on. If you've done nil wrong, it just finances that you were a). fitfully selected or b). something within your return looked a little unconventional and you need to verify it. Just show them the proof that your deduction were proper.

Being audited is not like peas in a pod as being accuse of something or being charged beside a crime.

If there be no audits, it would encourage citizens to cheat.

If you're that upset about your brother-in-law, why not do the ethical piece and turn him in?
nourishment happens.
relax a moment ago bring photos receipts locations of stuff u donated .
NOTHING else.

as for cheating bro in law there is a bounty available if u want.
It seem that people from other countries enjoy more leadway then we ever could, even if we're American citizens. They even are exempt from paying taxes on their business venture for 7 years.I used to know a man from cuba, who got a loan from the US gov. the first year he be here in the US. After 7 years here, he turned his business over to his brother, afterwards he started another one. It really isn't fair to us American citizens... I own been here adjectives of my life, and own had trouble even renting a Post Office box.needed three forms of ID. Then guess what ? Someone forwarded my messages w/o ID, then somehow have all of my post sent somewhere else for the first two weeks of Dec., 2007. All kinds of things enjoy happened surrounded by the past two years, of which I don't seem to be to have any control over. Don't hold a clue why this is happening to you... But I'm sure you'll come out on top !! They have you set on " auto-pilot" for so many years (( I don't deem they like it when anything change ))

Tax Question!?

My husband started his own business last year. He traded his own personal truck (which we owned, be paid for) surrounded by for a business vehicle. Is that considered a loss for us personally? Is in that a form for this? Does anyone know where I can read roughly this on the IRS website?

Answers: a trade means that your font ("cost") in the business vehicle is equal to the attraction of the personal truck when you traded it in. use edmunds.com or similar to find your effectiveness [the "trade-in" value].

then you depreciate the business vehicle on form 4562 and subtract the resulting depreciation plus all expenses of operating the truck and business on Schedule C [self-employed].

GL
It is not a loss. You received a benefit (lower price) for the trade.
Your starting place in the spanking new vehicle would be the value of the trade plus the brass paid.

I wouldn't use Edmunds as the other responder suggested. You get what you got on the trade, and Edmunds doesn't metamorphosis that result.
