Does an LLC hold to withhold from musicians they earnings soradically?

I didn't explain before. If the LLC or partnership hires a musician to perfom at an event does that constitute an member of staff and therefore withholding of taxes. I be told that a 1099 is sufficient. Please help.

Answers: That would mostly be true. From your description, the person does not nouns like an hand and should be treated as an independent contractor who would only want a 1099. Of course, sporadically means different things to different culture and by its nature this is a gray nouns. i.e. when you cross the line of human being an employee is not other clear.
You issue a 1099-Misc.
You issue the 1099-Misc based on the W-9 you asked them to crowd out when you hired them.

If the W-9 is incomplete (eg missing the SSN), you were supposed to withhold 28%. If the W-9 is complete you withhold nought.

My concern was that if you have no idea you be supposed to issue a 1099-Misc, I had a theory that you probably didn't get the W-9 or catch the SSN any other way.

Answers: Think of the 1099-S as a "sale" at $63,370.73.
The loss on the public sale is not deductible, but you need to enumerate it on a schedule D.

The 1099-C have not been issued on the other hand to account for the $17K of cancelled debt. If you lost the house contained by 2007, the rules for the Mortgage foreclosure act haven't be announced yet.
