1099 question---10 points for best answer!!?

My husband was working at a grassland maintenence company from Jan.-June 2007, he worked there for over 5 years. His boss would donate him "side jobs" to do after work, mostly throwing mulch, and only closing tax year, he begin giving him a 1099 for all the mu;ch and we have to pay taxes on it. Well, he stopped working in attendance in June of 2007, and simply got his w-2 but we dont know whether to dawdle around for a 1099 this year or not(supposedly he would only carry one if he did more that $500 worth of work) We think he did do more than that, but aren't positive. Can we dance ahead and file our taxes lacking the 1099 and file the 1099 seperately or subsequent year, if and when we get it? Also, is it trial for his boss to have 1099'd him for the extra after-work mulch job, even though he was already a full-time 6 days a week member of staff of the same company? Answers: 1. If the 1099 was for 2007 income, it cannot be file with a 2008 return. If you directory a 2007 return and later receive a 1099 beside 2007 income that was not reported on the 2007 return, you must amend the 2007 return.
2. The income must be reported on the return even if nearby is no 1099. If you knew the amount that be received, then you could report it and folder without the 1099. However, because you do not know the amount, you must any wait for the 1099 if nearby is going to be one, or ask the boss for the amount if it is there is no 1099.
3. If the work throwing mulch be performed as an independent contractor, later the boss is acting legally. If the work throwing mulch be performed as an member of staff, then the boss is acting illicitly. See the explanation at http://www.irs.gov of the difference between an employee and an independent contractor. It will not fit here due to the part limit imposed by Yahoo.
Your husband is supposed to report adjectives income.

As a contractor (assuming that he was classified correctly--WHICH HE WASN'T), he be supposed to keep his own library when paid so that he could database his taxes correctly.

Whether or not he gets a 1099-Misc is irrelevant.

If your husband's history show the "extra work" was $300 and the employer didn't put it on his W-2, next he should add the $300 to the wage file and fill out form 8919 to report the $22.95 contained by payroll taxes that weren't withheld properly. (The boss was to also compensate another $22.95!) When caught, the employer will start doing this correctly.

IRS file and excise fraud?

Where do I start. Let's see, I did an estimate of our taxes on HR Block.com and the result was that we owed $285.00. My husband be very upset. We did it Married but separtely and we come out with one and the same result, we both owed and it equaled to the same amount. Now, he requests to file single. I can not wallet single because that will be tax fraud and I am not of a mind to go to intern over a few dollars. So my question is that if he files single himself, will I win in trouble and can I still folder Married but separtely? I am confused and frustrated. If he does this, I do not want to go to prison over him self an idiot. I am very upset and confused, can some one sustain! Thanks.


Answers: He has no right to record single. He is married (even if he wants to be an ** he's rightfully married and it takes a while to finalize a divorce). He have no right to try to get YOU to perpetrate a fraud. He have obligations to God, to you, to himself, to his neighbors and that his word routine something.

IF that foolish "economic stimulus" plan comes along, this will be moot as you'll grasp back more than the not even $300 that he's inclined to perjure himself over and endanger YOU over. If you have to come up near the money, let that be motivation for you both to see if you will consider tax recover and start demanding it (I would hope for Steve Forbes' flat tax myself) but even newly writing the bozos to stop spending so much of our money is a good entity.
BTW, he WILL be caught. Everything is computerized. Maybe they won't get him this year, but they've get 3 years at least to find him AND adjectives that while the interest and penalties are building up. The IRS is ruthless next to middle class Americans. They'll cut a break with rich thieve, but they'll ruin YOUR lives if they can. It will be on his head, but you'll be caught surrounded by the web.

You won't go to lock away - But you will probably get an audit see. They will come back contained by six years and charge you about $1,000 dollars within tax, interest and penalty.

Find some better deductions, you can take home up for 300 dollars pretty easy beside home, education, charity and work-related expenses. These are legal deductions. If your husband files as single, and you folder as married or married filing seperatly - you own to put his SSN on your tax forms by decree. That will put both of you at a 100% audit risk.

Tell him to calm down and work the long-form to seize the deductions you both qualify for.
Why would he be freaking out over 285 bucks. Getting within trouble with the IRS is going to cost means of access more than that.
Cover your butt and file separately and married. It's officially recognized to do that.
Personally you get more of a charge break by filing together. But if you choose not to, next you are suppose to file, married file separately. I know people who don't and they enjoy not went to lock away, but that does not mean that they won't attain caught. I doubt if they will go to penal complex, they definitely own to pay subsidise the extra money they received, plus penalty and interest. So if he wishes to file single, by adjectives means agree to him, and you file the correct style if you are worried about the outcome. I intuitively do not mess around with the IRS. I never ever want to owe them anything!
Unfortunately, you are responsible for your spouses liability. Get a legall separation and then folder yours correctly. I don't think he would be stupid adequate to file single if you threaten him beside legal separation and turing him within. If he is, then do it. If one married is not worth $285 then capture a better guy.
I suggest filing MFS yourself. His return should be bounced put money on eventually because you will use his SSN # on your tax return when you folder MFS.
If you are married to someone who is unwilling, for whatever drive, to file married file jointly, after you MUST file married file separately, regardless of how he files. The only two exceptions are (1) if you are not required to report and do not file at adjectives, and (2) if you are "considered unmarried", are eligible to file as "pave the way of household", and do file as "manager of household". If you are required to file and any are not "considered unmarried" or are not eligible to file as "leader of household", then you MUST record as married filing separately.

No, not as of yet. While a bill is being debated in Congress right now, there's no way to know what the outcome will be -- or even if there will be an outcome -- until they finish up with it and forward it to the White House for signature.

Anything else is PURE speculation right now.
