My daughter was my dependent and a full time student finishing year (attended college 8/06-5/07). BUT, she got pregant, finished her sophomore year next got married on July 12, 2007 . She lived next to me until the end of July, 2007. In Aug., she did not return to college but go to live with her husband- they (plus twins now) live beside her father-in-law. He has agreed to permit me claim her. Is she still a qualifying child for me plan I can claim the EIC? (Tax booklet says "a full time student lower than age 24 at the end of the year"). Does her getting married cause her a qualifying relative and not a child? And, for the Hope Credit, it say "your child must be, during some part of respectively of any 5 calendar months of the year a full time student:). Can I claim the Hope credit since she only attended college from 8/06-5/07? Does that cover the 5 calendar month rule or ? As a student, *if* she didn't provide more than half of her support and she lived beside you until July 31, 2007, then you can claim her as a qualify child (as long as she *doesn't* file in somebody`s company with her husband).
If she files MFJ near her hubby and either one of them made more than $3400, wedding ceremony trumps dependency.
