If I haven't lived w/ my husband since 1/07, can I claim manager of household?

We live in Texas and trying to gain ready for taxes. Our 4 yr. son lives near me at my parents. I am claiming my son on my return. Can I claim head of household?


Answers: You do come across some of the requirements of Head of Household
1) You have be separated from your husband for the last 6 months
2) You own a qualifying child who lived next to you (this child must also be your dependent)

However, the biggie that I don't think that you come together, because you live with your parents (I hold to assume since January 07), is the provision that you must have rewarded more than half the cost of keeping up a home. I must also assume that you adjectives share the same home, that you don't hold a separate living space (not just your own bedrooms).
Based on this information, you do not qualify as cranium of household
YES you can,you can live in one and the same home as another taxpayer, say you "pay" rent to your parents and you support your child, food clothing and average every day things, you can claim it.

First Time Filing Jointly?

This is the first year that my husband and I are filing in somebody`s company (we got married February of final year).

My husband has an unpaid ticket and they usually filch his tax return for the ticket (they did finishing year). If we file in somebody`s company, are they going to take our WHOLE rebate check? Would it be better to wallet seperately?

This tax stuff confuses me!


Answers: Yes - if that traffic ticket is equal to or greater than your total settlement due, they will take it adjectives. They won't give any consideration to your involvement (or withdrawal there of) within his traffic offense.

Legally, do you have to file your taxes if you were a waitress?




Answers: Of course you do. Technically, you should pay taxes and report ALL income, including tips that haven't been reported to your employer. But realistically, you will only have to pay taxes on the tips that are included in your W2 income statement. The government only asks for an estimate of your tips - typically 8 or 10 percent of your food sales?? (this might have changed since I was a waitress). But whatever it is you report, you must pay taxes on.

The upside is this - as a waitress, you probably didn't make enough money to have to actually owe taxes, unless your employer didn't take anything out. Plus, you might be due an earned income credit. Regardless, file your taxes. You are obligated to pay tax on both your salary AND your tips.
