Answers: You are the singular one who can know what you should be getting. Checking against last year's return is usually a flawless start though.

I am a full time student contained by NY, My father claims me. I work and repay for university. Can I subtract my tuition?

I pay for my own tuition, room, and board at arts school (over 11,000 last year) and work 2 job. I still live at home over breaks. I want to find out if I can claim my tuition and/or my interest that my loans have accrue. TurboTax tells me that
because my father claims me I am not eligible to claim my tuition - But I rewarded it; not him! I assume I would get a heftier return if I be able to claim it...?

Stats:
Earned (2007) $8,500+
Fed Taxes Pd $700+
SS Taxes Pd $600+
Medicare Pd $160+
-------
Tuition (2007) $11,500+

What can I do? I'm afraid my father won't grant me anything if I just tender him the 1098-T for my tuition...

Answers: If you are a dependent, then no you can't filch the education credit, your dad can. Legally he doesn't own to give you any of it.

Although it's possible if you are paying that much of your university expenses, that you are providing over half of your own support, within which case he couldn't claim you.

And the student loan interest is lone deductible when it's paid, not when it's accrue.
Turbo Tax is right, you cannot claim that since you are a dependent. Perhaps next year you should database as an independent and not have your father claim you after adjectives it seems as if you're self-sufficient near the exception of the small amount of time you live with him. Play around beside turbo tax, you may bring to a close up getting all of your federal taxes put a bet on without have to claim the tuition since you didn't earn that much this year anyway. Also, note SS and medicare are not eligible for the duty return so you won't get that wager on.

What's my file status??

I married last year at the shutting of August, but if I file mutually with my husband, the system will garnish everything due to his student loans, and near goes my earn income and child tax credits! What do I do? Are here any loop-holes?

Answers: Bostonianinmo is correct. Your only option for filing are married joing or married separate - married separate disqualifies you for the credits and their are no loopholes to go and get around this. The form 8379 is an "Injured Spouse Claim" and it will get you the portion of reimbursement that would be yours separate from your husbands.
You can file a pooled return and file an injured spouse form. The reimbursement will be split based on the amount due to respectively person's income and withholding, and only his part of the pack will be taken.
