TAX evasion?
We had a guy do some paving work for us finishing September. We paid him $25,000 near a check, but didn't get his Tax ID number, because he "didn't hold it with him at the time", but promised to dispense it to us later. He cashed the check the subsequent day, and we haven't see him since. We shouldn't have remunerated him before we get the Tax ID, but we did (lesson learned). Anyway, we need to track him down so we can convey him a 1099, otherwise we'll end up paying his taxes. All we own is a copy of the check with his sanction on the back. The local Sheriff's Dept. said at hand was nil they could do.Any ideas on what we could do, or is it really that graceful to get away lacking paying your taxes?
Answers: The image of the check (or returned check) should own his bank and details number near the sponsorship. You could always receive a lawyer and own the lawyer articulate to the bank. The police won't do anything because your mistake isn't a crime on anyone's slice. If you don't use a lawyer, later the bank will probably clam up. Next time, don't take-home pay a consultant without adjectives the info you need for his 1099-MISC.
I assume this paving be for your business. Yes, you should have set better, but what's done is done. Where did you find him in the first place? Can you find him again that passageway?
Good luck.
It's unlikely for a one-time event that the IRS will demand that you settle over the 30% ($10,714) you were supposed to withhold if you didn't win a valid TIN (I'm assuming he was an unlawful alien, it's 28% for residents). It's possible, but unlikely.
File the 1099 anyway--otherwise you can't deduct anything on your business import tax return.

I am going to file my taxes. He have been living near me over 6 months of 2007 and he did earn less than $3400 contained by 2007. Can I claim him as a dependant? I own my own home and paid for most everything. I know I can't record as Head of Household because he is no relation to me. Any help would be greatly appreciated.Answers: No, you can not claim him.
Unrelated people must live with you the entire year (1/1 - 12/31) surrounded by order for you to claim them.
As is too normally the case, Robert's answer have misinformation. ALL non-relatives must meet the 12-month try-out whether they are adults or not.
