Virginia taxation department claims I did not record state taxes for 1994.?

They are now withholding my repayment for 2007. I was 19 yrs mature in 1994, my employer withheld taxes and no longer have the 1994's W2's. Va taxation will not release the W2's that they must have on directory, that would prove I had a reimbursement coming for that year. Now they are forcing me to double pay the due and charging penalities. What can I do?

According to the Tax Commissioner's ruling contained by this decision, they hold microfilmed tax files at least as far posterior as 1979 so, certainly they should enjoy the one that you filed within 1994.

The other people who posted answers be correct. You should get a attorney and insist that Virginia check their microfilmed history of individual income tax returns for the one that you file back later.

This come across crazy that they are asking for data that is to say over 12 years old. I cannot suppose that the State of Virginia requires tax payers to maintain information for over 7 years. 7 years is the longest I have hear of as a requirement. And I assume you heard nil about this till this year, right?

Being from California, I can't speak for Virginia but our when counterpart determines tax for non-filers it includes any withholding within the computation. Your state should at least be capable of give you a breakdown of income their assessment is base on and any credit you may be entitled to. The actual W-2 has probably be destroyed long ago.

Why is the IRS std. presumption for singles solely 5350? Shouldn't it increase at one and the same % your income increases

Exactly how is it figured. I assume it is tied to inflation or something or just goes up by a few % points respectively year, but how is that right that your income goes up by 50%, but your conjecture only go up by 5%.


Answers: The standard deduction is set by canon, not by income. It's indexed to inflation. Your wages are NOT indexed to inflation if they went up by 50%!
This is the precious "progressive" or "graduated" income toll system at work. Remember how "the rich should pay more"? Well the more you earn, the greater the PERCENTAGE lift from the government. If the conjecture were a percentage later we would be told how "the rich" are getting unfair tariff breaks.
Every time you hear a pol use a term similar to "the rich" you SHOULD note that he will NOT mark out it and very credible YOU are "the rich" to him.

When you say your grandmother gave you money, how much are you talking about. I am not a tax attorney or an accountant, but I do believe there could be tax implications if the gift was over a certain amount. But that could also come down to whether either of you report the gift.

However, if you're talking about money like for a birthday or something, then the answer is no.
No. It was a gift. If, however, she gave you a large sum of money and you are earning money from bank interest or investments, you do have to claim the extra money earned as income - but not the gift itself.
