Answers: If the brother was legally the parent on December 31, your brother could claim the child if you did not claim the child. If you both claimed the child, the parent with whom the child lived the longer time would claim the child.

If the IRS determines that you are considered a parent, having sign over your parental rights, you would be given the exemption.

Did your brother adopt her, if yes, when was the adoption finalized?
Depending on what you signed and if she is your brother's child by adoption or if she is his foster child and when that was made final.

If your brother adopted her or she became his foster child before the end of the year then she would be his qualifying child and your qualifyng child if she lived with you from April to December. He would win the tiebreaker because he would be considerd her parent.

You can wallet as married if you can get along for a while or separate if you can't. You don't mention any children so nobody can really comment around the potential for Head of Household.
as along as you live apart you may file as leader of household, but if YOU have kids, single ONE of you, whoever has custody, can claim the assumption.
