How does that work?Answers: You file married, file a separate return. This can hurt you because you lose the married exemption and basically folder at the single state. But that is the best file status for your situation. You are married but unable to locate your spouses information for anything reason.
If you would be entitled to a return but it would get zapped because of his irs eligible debts you can folder an injured spouse form. This allows you to receive what ever you are entitled to with out the irs taking money "he" owes but aren't your debts (ie: wager on taxes prior to marriage).
If you have children that you supported you can profile Head of Household. It basically give you the same deduction as being married.
You really should see a levy professional for specific filing status, I wouldn't do it on my own because they can facilitate you threw any rough spots.
Also you could contact his employers from final year and it is possible they would give you copies of his w-2's of his parents are not cooperative.

You enunciate you are legally married, but be you legally separated on or until that time 12/31/2007?
You may file as skipper of household if you meet ALL of the follwoing conditions:
(1) You are unmarried or “considered unmarried” on the concluding day of the year.
(2) You compensated more than half the cost of keeping up a home for the year.
(3) A “qualifying person” lived beside you in the home for more than partly the year
You are "considered unmarried" for the whole year if, on the finishing day of your export tax year, you are unmarried or legally separated from your spouse beneath a divorce or separate maintenance declaration.
OK, were you justifiably separated--in court? Then you file HOH or Single.
Did you of late separate, and not live together at all during the ending half of the year? Do you hold a child or children? Do you pay more than partly the cost of maintaining a home for you and child? Do you share expenses next to anyone else? Do you have gov't aid? In this specific armour you could be considered unmarried and file HOH.
Your other option are to file MFJ (jointly) or MFS. Filing MFS limitations the credits you can receive. If you file MFJ, you requirement his signature, or a Power of Attorney to signe for him, and probably should file an injured spouse allocation.
You own a choice between joint return, married file seperate and head of household (since you lived apart beside him for the last partially of 2007), work it both ways and see which is beneficial. Wife hasn't received W2 from behind the times employer?
We've tried contacting their corporate office several times. The ONE time we get through to a live person and not a answering apparatus, they wanted to charge us $9 for reissuing a "lost" W2.
