Can I chronicle my husband as a dependant on my duty return if I cant find my matrimonial license?

My husband is in college and lone I work. My social security card have my married name, but my passport does not. I do not own my marriage license. Will they permit me list him as a dependant?


Answers: If you are legitimately married, you can file as spouses. (He's a spouse, not a dependent.)
Your spouse is never your dependent. If you database jointly you draw from an automatic exemption for him. You will not need to convey anything to the IRS to prove you are married. They already know this from the SSA

Answers: Only a check if you owe money. They used to require a signature form but now you can e-sign. W-2's are not required. The affairs of state has yours already, anyway.

Who can claim my husbands children on taxes?

My husbands EX wife has primary custody and he have secondary custody of 3 children. The EX is not married nor have she worked at all surrounded by 4 years, but she lives with her boyfriend and get welfare and childsupport the children are with us 4 night every other week during school and 7 night every other in summer. Who can legitimately claim them?


Answers: Let's see, she lives with her boyfriend within his house. So the boyfriend provides housing.

Let's see she gets welfare contained by addition to child support.

It would appear that NOBODY provided more than 1/2 of a child's support this year. So it's entirely possible that NOBODY can claim the children this year.

The ex-wife didn't work, so she won't be claiming them.
Your husband didn't provide more than partially of their total support (if you can't calculate it, you can't prove it), so he can't even ask her to sign a form 8332.

The boyfriend would enjoy be able to prove he outspent welfare and child support next to the support he provided. Doubtful. If he can, he'd be eligible for the $3400 exemption ONLY.

While there is a multiple support form, 2120, I doubt everyone will be feeling like to sign off on it to permit somebody legitimately claim the $3400 exemption.
Which ever parent the children lived with for more than partially of the year can claim the children. If they spend the same amount of time beside each parent the parent beside the higher AGI can claim them. I detestation to tell you but if the children lived near the boyfriend the entire tax year and she does not enjoy any earned income and he files a return he is the one who can claim the children unless someone else is providing over partially of their support.

Publication 501 on irs.gov website explains what is taken into consideration for the support test. Because your husband is not paying anything toward the household expense he cannot be paying more than partly of their support.

I doubt the welfare the x receives for the children singular is covering more than half of their support when you purloin into consideration, lodging, food, medical, dental, clothing, education, respite, transportation and similiar necessities
