Can taxpayers who frustrate ALMOST (not all) of their foreign earn income via 2555 receive the Bush rebate?

If a taxpayer cannot exclude ALL of their foreign earned 2007 income (as they earn more than 87,500$/year) are they eligible for the Bush rebate? With the income non-excluded, the taxpayer may have at tiniest $3,000 in income they must "declare" but still not own a tax liability. Would this qualify them to receive the rebate for "lower income" workers category. (Those who made at smallest 3,000 $ but do not have any charge to pay.


Answers: Any rebate is base upon your tax liability and AGI. If the FEIE reduce your AGI to less than $3,000 and you hold no tax liability you would not be eligible for any rebate.

That said, the IRS have not yet announced procedures for FEIE claimants. I've given the legislation as passed a cursory review and didn't see anythign directly address that issue, however most references surrounded by the legislation refer to the relavant sections of the Tax Code forcing you to repeatedly refer to the Tax Code to determine what the legislation in actuality says. It's entirely possible that it's address but I just haven't found it however.

The IRS will likely address the issue on their website eventually. Given the small number of claimants -- it doesn't even enjoy its own line on Form 1040 -- it's not a priority next to the IRS to address the issue. I would guess that it will be another month or two at least in the past they post anything on their website relevant to your situation.

What should i do if no one was eligible to file for my child not even me the mother, and someone did anyway?




Answers: There's nothing that you can do. That's an issue between the person who did claim the child and the IRS. You can't even find out if someone else claimed the child unless you file a tax return claiming the child yourself.

Tax returns, even fraudulent ones, are a private matter between the IRS and the taxpayer. The IRS will not discuss someone else's tax return with you unless you have explicit written permission from the other party such as Power of Attorney.
You cannot find out, thru the IRS who filed on the child. If you do not know who did, then you still need to contact the IRS and ask them what you can do.

Is within a statue of limitations concerning unfiled put money on taxes?

I heard it be 3 years

Answers: As a matter of standard policy the IRS does not pursue export tax debts older than 6 years where on earth no tax return be filed. Although here is no statute of limitations on Tax Fraud, failure to folder has be ruled to be neglignce, not Tax Fraud.
1913 but six years is the general policy. You will not receive a discount on a return more than three years overdue.
