Ex spouse claimed dependents on federal income due?
I am the custodial parent... and he paid child support $200 a month for solely 5 months last year!! It is a shame that this happen, I was the custodial parent, my husband have a really good legal representative and when the divorce decree be written, it made all the child support payments alimony. It did not read aloud alimony, but the IRS read it as such. He paid 75 dollars a month and consequently got to nick it off at the pause of the year. I had two little girls, and it made it so complex. You really have to enjoy a good divorce advocate to make sure things close to this do not happen.
If you are entitled to claim the exemptions for the children and your ex already have, you won't be able to e-file this year as you've probably already discovered. However adjectives is NOT lost!
File a paper return claiming the children, along beside Head of Household filing status, the EIC, Child Tax Credit and Additional Child Tax Credit if eligible for those. The IRS will consequently contact both of you to sort out the issue.

Then if an amended return is not filed inside a few weeks, they will ask you both for proof of your claims. You'll need to provide proof that the children lived beside you for the greater portion of the year. Doctor's and school annals are the best bet there, as are copies of lease showing them as occupants of the property and even sworn statements by neighbors beside knowledge of the facts.
The IRS will help yourself to the information provided by both of you and decide who is entitled to the exemptions lower than the law. You'll win that round if you responded to the IRS request for proof within a timely manner and at that point it will be Game, Set, and Match for you.
Your ex will carry a bill for any taxes due due to the loss of the exemptions. And if he was stupid plenty to have claimed the Earned Income Credit as in good health, he stands to be barred from any EIC claims for the subsequent 2 to 10 years depending upon the facts of the case.
