The short answer is yes. If you owe state taxes they will take what you owe and send the difference to you. The local government will do the same respectfully. You have to be sure to file and meet the criteria to qualify for this refund. 1 of the criteria is you have to make less then 75k the last taxable year(2007) or a combined household income of 150k. (and you have to be married or common law filing joint) It is always best to get a second opinion. I suggest calling the IRS direcly. If you owe, it is best to talk to them and don't let them come after you. They will be glad to work out a payment plan out with you.

In the upper right corner is a box for searching. You need to search on both the tax year and the form
2006 1040 (or 2006 1040ez or 2006 1040a depending on what form you need to file).
2005 1040
That should take you directly to the list and it should be easy to find the form and instructions. Then it is filed just like any other year.
But, you are not able to use software to file them. If your taxes are too complex, your best bet may be using an accountant or call HR Block and see if they do past years returns.
Keep in mind if you are owed a refund you only have until April 15 to file for 2004 to still get your refund.

Is the $150,000 ceiling for the tax rebate based on your adjusted gross income?
Answers: Yes. There is a great deal of confusion about this but everthing I've read in many different locations confirm that it is based on the AGI. Actually, I'm kind of surprised that they were able to get this passed as an AGI of this amount is getting up there pretty high in the income levels. Will they use the 2006 1040 for AGI? Or 2007?
