May a relations trust details stretch an Ira?

Question:
having a trust inherit an IRA instead of an individual contained by order
that other siblings will receive funds as per trustees

Answer:
Having a trust as beneficiary may be simple, but is seldom the best import tax planning. Depending on the age of the owner at death (before or after required minimum distributions start), the payout spell could be as short as 5 years if a beneficiary is not an individual. There are ways to stretch the payout period base on the life expectancy of the owner and/or beneficiary. If it's not too behind time (is the owner still living?), consult with a financial planner next to experience in estates. Your state's CPA society is a honourable starting point for a reference.
A trust roughly does not have a existence expectancy, and that's what is required in proclaim to have any IRA beneficiary whip a payout over any extended period. Certain trusts' beneficiaries can be designated beneficiaries for payout purposes, but the rules are incredibly specific--it depends on the type of trust--a living trust doesn't satisfy the requirements. There are some spanking new rules, commonly known as "stretch" or "multi-generation" rules, that can apply to an IRA set up properly. Talk to a excise CPA or attorney about the clean regulations under Regs. Sec. 1.401(a)(9). The stretch concept allows children of an IRA owner to transport payouts over the children's life expectancies, and the multi-generation concept allows even grandchildren to be name beneficiaries and to receive payouts. Most current IRA custodians, such as banks, don't own the ability to track these extended inherited lives, so you have to take care about setting up the IRA next to the right folks.

If all you want to accomplish is to allow more than one party to be an IRA beneficiary, simply name adjectives of the siblings (I presume this would be children of a parent) as primary beneficiaries. (Be careful not to run afoul of a surviving spouse's rights and choices.) Their choices at the loss of the IRA owner may be limited to 1) a lump sum, or 2) a 5-year payout, but at least possible you're accomplishing the purpose of spreading the funds to multiple beneficiaries.

Can I contribute to my 401k and a roth IRA?

Question:
I have $4000 surrounded by my roth IRA for 2006; and another 4M for a 401k..

Does a 401k count as an IRA? Because the 401k money has already be taken out of my paycheck and is not part of my w-2 wages. But do I claim it as an IRA?

I basically don't know what I need to report to the IRS. If I put the 401k income as an IRA (in extension to the Roth IRA) it tells me I own over contributed to the account and must repeal or I can't use my roth.

>help<

Answer:
Hi Mary,

First thing is 401k is NOT a IRA type description. It is a retirement plan account offered by your employer while IRA is individual retirement explanation.

So do not count 401k towards IRA contribution. In fact 401k maximum contribution is $15000 for year 2006 irrespective of your IRA contribution.

If you are eligible, you can contribute up to $4000 to IRA accounts contained by total.

In case of Roth IRA, typically you do not stipulation to report to the IRS as your broker/bank (which holds your roth account) informs IRS about it via form 5498.

Check this comparison of 401k vs Roth IRA:
http://theusefulinfo.com/finance/compare...

Not a decriminalized adive.
- Infoman
A 401k is totally different from the Roth IRA so don't worry nearly it. A 401k is pretax and a Roth IRA is post tax. Good luck.

Any toll law, for offshore oilfield workers?

Question:
I work in the offshore oilfield industry, I'm gone 6-7 months out of the year surrounded by international waters,,, Single and making good money, I'm paying alot of taxes, are within any tax law, that will cut me a break? Since I'm gone so much?

Answer:
In order to avoid paying US Taxes you hold to be gone from the US for all but 30 days per year. If you stay longer than 30 days surrounded by the US in any given year; you discharge taxes for the entire year.

I used to run crew changes and crew HR for international people who worked on our company drilling rigs all over the world. Most of the US men would return with an apartment or home in some other place contained by the world rather than money US taxes. You also have to database a form with the IRS stating that you are going away the country and they will keep track of your entrances and exits within the US.

But the hitch here is that usually when a company hires a person they want to fly the personality to and from their home base. When I be in charge of the crews I consent to them leave or travel to any place they wanted to turn but some companies are sticklers.
You're not in a foreign country so you do not qualify for the Foreign Earned Income Exclusion. You must be physically present surrounded by a foreign country to get any charge breaks; international waters does not cut it and is specifically excluded by law.
